Patna HC strikes down Bihar prohibition law, calls it illegal
The Patna High Court on Friday struck down the Bihar Excise (Amendment) Act, or the law imposing prohibition of liquor, terming it ‘illegal’.
Four months after Bihar passed a law banning alcohol in the state, it brought about amendments by which all adults in a family were made liable if one drank or kept liquor at home.
Additionally, the law allowed the Collector to extern a drinker for 6 months.
Some provisions in the Act, such as collective fine on villages/localities violating prohibition law or all adult members of the family to be arrested and sent to jail if liquor was found in the house were seen as draconian and very vehemently opposed.
