New Jersey Traffic Offenses: Penalties, Points & Legal Defense
Driving in New Jersey is a privilege, and traffic violations can carry serious consequences—from points on your record to fines, surcharges, and even license suspension or jail time. At JSD Legal in East Windsor, our experienced attorneys help clients navigate the complexities of traffic offenses, minimize penalties, and protect their driving privileges.
MVC Points System & Surcharges
New Jersey’s Motor Vehicle Commission (MVC) employs a point-based system to track traffic violations. Points are assigned only for moving violations—not parking infractions. Accumulating six points within three years triggers a surcharge: an initial $150 plus $25 for each additional point. Points can lead to license suspension at 12 or more points on your record.
Driving on points also impacts your insurance—many providers raise premiums after violations. Remaining violation-free for one year, completing a defensive driving course, or enrolling in MVC-approved programs (driver improvement or probationary driver programs) can reduce points by two to three.
Additional Surcharges for Specific Violations
Certain serious offenses trigger automatic surcharges for up to three years:
Unlicensed or expired license: $100/year ($300 total)
Driving while suspended: $250/year ($750 total)
Operating uninsured vehicles: $250/year ($750 total); uninsured moped: $100/year ($300 total)
First or second DWI/DUI: $1,000/year ($3,000 total)
Third DWI within 3 years: $1,500/year ($4,500 total)
Refusal to submit to BAC testing: $1,000/year ($3,000 total)
Failing to pay these surcharges results in license suspension, collection actions, and a Certificate of Debt filed with the Superior Court. This judgment may lead to wage garnishment or prevent property transfers. A $100 restoration fee and any outstanding surcharge must be paid to reinstate driving privileges.
