len agrees with mick , to a point , but he knows that the question of proof is just trying to put more things in their favor , and he’d prefer their deck be stacked . “ intrusive thoughts , ” he corrects mick absently , not a hint of disdain or condescension , just a habit with mick’s aphasia at this point .

“ my sister and i have a monthly session together for our upbringing . i’m in every other week for kleptomania and anxiety . marco - mardon - goes weekly for his depression - just this past week was two months on a new med . axel’s working on some cognitive behavioral therapy with his doctor right now , and we’ve seen less calls from the school since he started going . his therapist has also suggested adhd testing , he’ll probably start that next week . ”

a sigh escapes as he scrubs his face - not everyone is so receptive to going , or following suggestions . “ macculloch - mirror master . he’s been stubborn . but the kid did get to one narcotics anonymous , an’ he’s consistently been picking up shifts at saints and sinners - our bar - as a way of giving himself less idle time for the temptation . which is - far better than he was when he first arrived . it’s effort . ” evan’s still a shit , but he’s , shockingly , trying .

Matt makes some mental notes as they talk. As he understands it, the Rogues more or less banded together over their mental disorders in the first place even if that hadn’t quite been their intention and their goal at the time probably wasn’t recovery first. Even if they would go for it, they’d never get a good ‘mentally unsound’ verdict- and Matt doesn’t particularly want to try for that. 

They really seem like half decent people and no in large part because they have been telling him the truth. 

“You can show someone proof of anything,” he promises. “Getting them to believe it, however, is a different story. That’s what I’m here for.” 

“We’ll get your respective therapists for character witnesses, they’ll offer good insight on your progress with your respective therapies. Following up their testimonies with taking the stand for yourselves may be a powerful influence, as well. That we’ll have to judge as we go, however; if your records are indicating of anything, not all of you take the stand well,” Matt explains, talking a bit quick as he gets into it. 

“But proving your characters aren’t enough to convince anyone you didn’t murder these people,” he goes on. “These will just be supporting claims- we’ll need actual evidence that says you couldn’t have done this. As I understand, you all use a fairly unique arsenal of equipment and enhanced abilities. I’d like to be able to sit down with each of you and go over the more technical details of your gear.”

“ appreciated , ” len murmurs in regards to their son , settling in with the briefest flicker of a smile at mick’s growl . this is going to be tough , but len’s not about to turn murdock down on anything - he knows better than to look a gift horse in the mouth , especially when it comes to an attorney doing something like this of his own volition and not because the rogues are dipping into the bail / jail fund . attorneys in general can be lifesavers when the rogues already have so many marks on their records , and this guy - len likes him , he thinks .

“ i’m sure anything they gave you’ll be useful , ” he hums , nodding . “ carry on , counselor . ” his hand moves to brush mick’s briefly lacing their fingers and squeezing - he knows how the anxiety of the case and the boredom of the session is probably affecting his husband , just as it is len .

Their record may not be clean as it is but several degrees of murder charges against their ‘collective’ would make it next to impossible to get them any lesser charges in the future- and Matt is sure this isn’t the end of their criminal career. Granted if they go in on murder charges at all, they’re not exactly getting out any time soon.

Matt is well aware of Iron Height’s reputation. 

“Excellent,” he murmurs and he fishes out his tape recorder from his shoulder bag to set on the table for note taking.“I understand most of you have attended therapy. Can you tell me when the last few times were? Who went and what for? Have you been adhering to your therapists’ suggests and can you offer any sort of proof of that?”

the rogues have rules . that’s part of what makes them the rogues , and part of why they turn down certain people . they’re used to backlash for that choice , but blacksmith is - this is too much . this is part of why len has always hated the mob , because turf wars can get people killed , and , even though he knows none of his people pulled the trigger , the guilt still sits heavy in len’s stomach .

he may be innocent now , but he’s going to put blacksmith down as soon as he gets the chance .

he doesn’t express any of that to their lawyer , even if he has decided that the man is good people , a ghost of a smile twitching across his face when murdock calls the rogues’ body of work victimless . he’s more expressive than he’s like to be , flinching at the mention of younger rogues , fingers laced tight together to resist the urge to anxiously tap his ring against the nearest surface , or to take something ( thanks , kleptomania ) . “ axel’s old enough that i don’t doubt someone will push to have him tried as an adult , ” he speaks up - len’s been unusually quiet . “ and even if that doesn’t go through , this - this could easily have him removed from our custody and sent back to his biological family . anything you can do to keep our family together , mr . murdock . ”

Matt pushes the stack of their prior charges off to the side for now and sighs. He is taking their case, of course, even if trying to find an impartial jury in this city is going to be an absolute nightmare. As he understands it, though, he’ll at least have several of the Flashs’ full cooperation which always helps. 

“Well, at the very least I can promise we can get Axel acquitted of all charges,” he assures. Hopefully that doesn’t mean throwing everyone else under the bus but it’s not like Matt has any problem with playing up the kid’s disability- or really any of theirs.”And I assure you, I will do everything in my ability to keep your family whole.” 

“Our most important task here is going to be keeping the murder charges off you. Even if you take the charges for less severe crimes, proving that you aren’t killers is what’s going to save your records going forward,” he explains. “Do you mind if we go over some of the information Mr and Mrs. West-Allen gave me? It’ll help us understand what kind of case we can build here.”

Matt is in Keystone City on a favour of a favour for a friend of a friend of a friend. Normally, this wouldn't be his jurisdiction but he's not actually here as Daredevil. He's here as a lawyer- and one very good at defending vigilantes in court at that. 

But he wouldn't really file these two under the 'vigilante' title. 

Matt mouths some things quietly as he runs his fingers over page after page of the braille print outs provided. The stack is huge and he places each paper from one into another pile as he finishes them. This is a lot. This is- Matt runs his hand down the side of the stack but it definitely doesn't feel like it's gotten much shorter. He takes his hands off the papers and folds them on the table with a deep sigh. 

Ya'll straight trippin'.

"Mr. And Mr. Snart-Rory," Matt says. "I do understand your problem here, believe me. Having, at this point, at least three first degree murder charges, conspiracy to commit, not to mention accessory and accomplice charges on your records isn't good- especially for the younger members of your family. Your records are lengthy, yes, but obviously these are all, between the three of us, victimless crimes." 

"I don't believe you're guilty, no, but with your track records-" Matt goes on and he sighs, shaking his head. It's not out of contempt or dislike but simply the sheer vastness of it. "If I take your case, you have to understand that I can not guarantee a success. Even with a bulletproof case, a jury may very well convict you on just- this." He gestures to the stack of papers.
