文言上は養子になれる要件を1947年以前に皇族であった者の男系子孫に限ることをせず、従って全国民が平等に扱われるので違憲の疑いはないが、皇室会議の承認を要件にしておいて実際の運用では養子が旧皇族子孫の場合だけを承認する、という制度設計に最終的にはするのであろうと推測しています。
