The ruling will not affect Biden’s lead in Pennsylvania.
A rare legal win for Trump!
In Pennsylvania, a voter who fails to provide proof of identification with a mail-in or absentee ballot has until November 9 to provide it. This year, due to the COVID-19 pandemic, the Pennsylvania Secretary of State extended the deadline by three days, to November 12. Trump and the GOP promptly ran into court to object. The voters themselves were legal, the ballots themselves were timely, and there was no suggestion of fraud or any other impropriety. But because mail-in and absentee votes tend to favor Biden, the Trump campaign wanted to maximize all possible voter suppression.
A court ordered Pennsylvania to segregate and not count the disputed ballots pending a decision. The state complied. The court has now agreed with Trump and the GOP, ruling that the Secretary had no authority to extend the deadline so these timely ballots from legal voters must be disregarded.
Because the court had already ordered these ballots temporarily excluded from the totals, however, the court’s ruling has resulted in a net loss to Biden of exactly zero votes in Pennsylvania.
