GMO Lawsuit: Farmer Sues Neighbour for Crop Contamination by GMO Seeds
A WA farmer has started legal proceedings seeking actions against and damages from his neighbour and fellow farmer for contamination of his land and organic crops caused by genetically modified seeds used by the latter. The litigation may prove to become a significant milestone in the fight against GMO crops citing adverse health and environmental impacts.
Steve Marsh and Michael Baxter are two childhood friends and their farms adjacent to one another. Marsh grew organic oat and wheat while Baxter had genetically modified canola plants, source of edible oil and biodiesel. The GMO seeds from the latter’s farm blew onto and contaminated the organic farming at the field’s field.
Marsh has lost his Standards Australia “organic certification and export licence” because of GMO seed contamination and faced with loss of income, according to his negligence injury lawsuit filed in the Supreme Court.
The litigation highlights the potential impacts of GMO crop farming on the farmland in the vicinity and responsibility of users to ward off its adverse impacts on other crops, specially the organic one.
The defendant brought his GMO seeds from Monsanto, which is subject to controversy for its aggressive marketing and muscle flexing to promote its seeds. The seed company signs a no-liability agreement with farmers buying its seeds to prevent litigations against it.
On the other hand, Australia follows a strict zero tolerance policy against organic crop contamination. The lawsuit is likely to result in more stringent regulation.
According to experts, genetically modified crops is harmful both for human and crops. It results in herbicide-resistant weeds that other crops fail to endure. GM food is also regarded less safe and nutritious.
Such adverse impacts in the United States have led the Organic Seed Growers and Trade Association to seek “pre-emptive legal protection for farmers whose fields were inadvertently contaminated with crops containing the genetic modifications.”
