The Supreme Court's decision to pause the sedition law is a significant development. For decades, successive governments have used the colonial-era law - the dreaded section 124a of the antiquated Indian Penal Code - against students, journalists, intellectuals, social activists, and those critical of the government to essentially suppress dissent and free speech. A law which was mainly used against Indian political leaders seeking independence from British rule in the 19th and early 20th centuries has now been weaponised as a tool of suppression by successive democratically elected governments.

The Bombay Prevention of Begging Act criminalises the very act of being poor and homeless, even if you are not begging for alms. It gets worse. The law allows ‘any police officer’ to arrest the person who is engaging in ‘begging’ as defined above without a warrant. Some context: under the Indian Penal Code, you need a warrant to arrest a person who engages in assault or criminal force with the intent to dishonour a person, or in adulteration of food or a drink intended for sale so as to make the same noxious. You may commit these serious criminal acts, but a cop won’t be able to arrest you without a warrant. If you are poor and seek alms or sell anything on the street, you deserve to be arrested immediately according to the wisdom of the legislature. The poor and homeless can get arrested even if they don’t beg. How this plays out in real life is not hard to imagine. Cops frequently threaten the destitute and demand bribes from those who are forced to beg.
