The age of sexual consent in the Philippines is 12 years old, which means that sexual acts with children below 12 years of age is automatically considered rape. The victim will only need to prove her age and that the rape happened.

But this also means that over the age of 12 or by 12 years old, sexual intercourse is possible provided that there is consent and that no force was used. This is an obstacle because victims need to prove that they did not agree to have sex. While in court, many investigators assume that the child willingly participated when they did not scream or run away.

Pagsusuri sa Artikulo 14, Seksyon 8 ng Philippine Konstitusyon

         “This Constitution shall be promulgated in Filipino and English and shall be translated into major regional languages, Arabic, and Spanish.”

         Ang Konstitusyon ng Pilipinas ng 1987 ay orihinal na isinulat sa wikang Ingles at ang pahayag sa itaas ay ang isinasaad ng Artikulo 14, Seksiyon 8. Ang probisyon na ito ay nagsasabi na kailangan mailimbag ang Konstitusyon ng Pilipinas sa mga pangunahing wika ng bansa. Malamang ito ay para mas maintindihan ng masa ang nilalaman ng Konstitusyon sa tulong ng midyum na Mother Tongue.

         Pagkatapos ng isang maikli na pagsusuri kung naisagawa ba talaga ng pamahalaan ang nilalaman ng probisyon na ito, ay nahanap ang sumusunod na pagsasalin sa isang opisyal na webpage (gov.ph, 2016) ng gobyerno.

         Sa ngayon, ito lang ang nag-iisang pagsasalin ng Philippine Konstitusyon at, sa masamang palad, ay hindi pa nga ito totoong opisyal. Mapapalalim ang kaintindihan nito kapag binasa ang isang excerpt sa ibaba na galing sa dyaryo ng Inquirer.

         Senator Loren Legarda states the need for an official Filipino version of the Philippine Constitution but she also wants it translated into major regional languages, Arabic and Spanish.

         “Although there was an ad hoc Filipino version, this was apparently appended to the English version much later than the ratification of the Constitution in its English form. In other words, twenty-seven (27) years have passed since the ratification of the Constitution, there is still no official version of the Constitution in Filipino or in other languages specified therein.” 

         The senator then pushed for the passage of the proposed measure. It was provided in a proposal under the Senate Bill 2862, which she has filed at the Senate.
