Apple's iBooks Author publishing model is all kinds of wrong

Okay, Apple's fucking something up. They fuck up at times, and I'll go into that in another post at some point, but this one needs to be addressed now.

Apple's just announced iBooks Author, which lets you create media-rich, multitouch textbooks for the iPad. Neat. But the end-user licencing agreement (EULA) is pretty shitty:

IMPORTANT NOTE: If you charge a fee for any book or other work you generate using this software (a “Work”), you may only sell or distribute such Work through Apple (e.g., through the iBookstore) and such distribution will be subject to a separate agreement with Apple.

So, if you use Apple's free software to create a book that you wish to make some money off of, you can only sell it through Apple. Them's the legal terms, anyway. And they suck.

I don't have a problem with Apple getting a cut. I don't have a problem with Apple making money in general. I do have a problem with Apple restricting how and where and through whom and to whom (since not everyone in the world will have an iPad) I can sell my work.

 No matter how much Apple's helping out with free software, that help will never not be more valuable than my work.

This bears repeating: My work, what I make, the output generated using iBooks Author, is worth more than the tool used to create it. 

Yes, according to the terms, you can give your work away. But if you decide to sell something, you're stuck in one sales channel and totally subjected to the whims of that channel.

That channel, however, may not be the best available -- my work may get lost in much the same way apps get lost in the App Store, or Amazon may take the lead in e-textbook publishing. And anyway, selling through only one channel is bad business when not everyone can access that channel.

In sum: The serious creator must be able to decide how to sell his or her work in order to be serious about creating. No one who creates for a living is happy when they have no control over that creation's future in the marketplace.

Apple's EULA kills a fundamental part of creating: Control. And in taking away control from creators, Apple takes away incentive for creating works with its tools, which fundamentally harms Apple's proposed model for making some cash-money.

What if I create a textbook in another program, publish it, then use iBooks Author to create a version for the Apple audience?

Am I in breech of the EULA?

Or is the Apple version the only version bound by Apple's terms?

An idea: Apple wants its cut for helping you -- the scholar, the writer, the person who made information understandable and interesting -- create and publish and distribute your work.

So let us pay for it. 

Unlike other applications out there, Apple will ensure we will pay for iBooks Author -- which, on the surface, looks pretty freaking amazing -- by distributing it through the Mac App Store. 

If we like what we've produced, we'll explore publishing. Apple will present its terms, and we'll decide whether or not they meet our needs. Apple's got a lot to offer when it comes to distribution -- an easy-to-access channel, iCloud, in-place payment system -- so we'll pay for that, too. 

But if for some reason we don't like the terms, we'll take the product of our work and sell through alternative channels. We'll have paid for the tool to create the work, but we won't invoke Apple's services with our product, thereby not incurring costs associated with those services.

Oh, you mean this is how we used to do it? Dammit.

Apple has to recognize that the current terms of use for iBook are intolerable. If Apple serious about this market, it needs to revise its EULA. Like, now.

Is this the new publishing model that will work?

I've been very interested in the conversations that have been doing the rounds regarding the future of news publishers and how they are going to survive going forward. Should they charge for their content like Rupert Murdoch is convinced is the way forward (his "The Times" newspaper website put up the pay wall that started this conversation), or should they give away their content for free and try to make money off the advertising?

Personally, I'm not convinced about either of these models. In an era in which people are used to free access to information on the internet, I just don't see a place for a pay wall. Alternatively, the publishers cannot survive on just advertising in its current format. This is why this morning I was very interested in seeing how the "Financial Mail" (South Africa) website is operating.

To start with, you get access to 3 free articles per month, this is assuming you don’t delete your cookies I would imagine. Even though I realised this is how it was keeping me from viewing more than my allocated 3, I did not actually go and delete the cookie! If you want to view more than your allocated 3, then you have to register with the website.

Now, there is a bit of a flaw in their design of this process, as only today did I realise that this is a free registration and not a payment based one, which I had thought it was all along (I have been viewing this website for a while), but that is not the point of this post. When I think about the process, I was happy to give them a bit of information about myself to get the content I was after:

My point is that they are simply asking for a bit more information about the people who are viewing their content, which I assume is going to be used to amplify their advertising offering, not only by sending newsletters (I opted out of those), but also by offering the allure of data about their audience to advertisers, since now they know what I do now, and what industry I am in. This will, I assume, allow for more decently targeted advertising which is good for us the consumer, the advertiser, and ultimately the website, which will possibly lead to a better income stream for FM.co.za

I’m not saying this model will work, I just think it’s an interesting twist on the operating model, and will be interested to see how it turns out.
