It is one of the reasons why police stations and prisons are congested because arrest are often times made by allegations that are purely civil in nature. There are several instances where the police arrest relations/friends or close associate of a crime suspect to compel the suspect to give himself up even though that person was not linked in any way to the crime alleged against him. Many are being taken away unlawfully from their homes, families and business on the basis of crimes they know nothing about, some are currently in the detention centers tortured to write a statement without the consultation of a legal practitioner/ next of kin or any other person of his own choice. Every nigerian knows of this injustice, our media speaks of these ills and police brutalities that have claimed so many lives and left their families in pains. Section 34 of the Adminstration of Criminal Justices Act provides that the chief magistrate or any magistrate designated by the chief judge are charged with the responsibility to conduct an inspection of police stations and other places of detention every month. During the visit, the magistrate may; (a) call for and inspect the record of arrest (b) direct the arraignment of a suspect or (c) grant bail to any suspect where bail has been refused. If detention centers are visited monthly, we can be assured that no nigerian will be in detention for more than a month.
