Disposed of on 27.12.2023 by the Bench of Hon’ble Mr. Justice Jay Sengupta J with the observation that the respondent police authorities shall keep a sharp vigil at the locale, ensure that no breach of peace takes place and no order of a Civil Court is violated.

Surveillance shall include frequent visits to the area by police patrol.

To harass and demotivate the petitioner, the respondents supported by locals resorted to social boycott of the petitioner and his family members.

Facts

This is case where a temple was illegally constructed in front of the property of the petitioner Ranjit Mondal. When petitioner objected to it there was social boycott of the petitioner and his family members by the private respondents and the locals residing there.

Petitioner approached Civil Court, Arambagh, Hooghly seeking order for restraining the defendant nos. 1 to 6 from changing the nature and character and possession of 3 feet wide and 40 feet long common passage existing in between the suit plot by way of encroachment.

Interim Injunction was granted on 22.11.2022.

Petitioner also made a complaint that private respondents are trying to disturb the possession and enjoyment of the property as a result police authorities have also come in action and proceedings under 107* Cr P C was initiated.

107*Cr P C in case of emergency when breach of peace is imminent, Executive Magistrate orders the accused person to agree to a bond which asks him to maintain peace for the prescribed period of time as the Judge thinks would fit.

चैतन्य भारत न्यूज जशपुर. छत्तीसगढ़ के जशपुर से एक ऐसा मामला सामने आया है जो आश्चर्यजनक है। दरअसल यहां के केतार गांव के रहने वाले युवक उत्तम कुजूर को समाज से सिर्फ इस वजह से निकाल दिया गया क्योंकि उसने मकान बना लिया, कार खरीद ली और अब शादी करने जा रहा है। परिवार ने पुलिस अधीक्षक और कलेक्टर से इस मामले में मदद की अपील की है। (adsbygoogle = window.adsbygoogle || ).push({}); खबरों के मुताबिक, गांव में एक बैठक आयोजित की गई जिसमें कुजूर और उनके पूरे परिवार का ग्रामीणों द्वारा बहिष्कार किया गया। बताया जा रहा है कि उत्तम कुजूर की गांव में एक दुकान है। बैठक में कहा गया कि युवक की दुकान से कोई कुछ सामान भी नहीं खरीदेगा। अगर कोई भी ग्रामीण इस फैसले को नहीं मानता है तो उसे भी पांच हजार रुपए का जुर्माना देना होगा। उत्तम ने बताया, 'कोई भी हमसे बात नहीं कर रहा है और ना ही हमारी मदद कर रहा है, और अगर वे हमसे बात करते हैं तो 5000 रुपए का जुर्माना है।' अब गांव के इस फैसले के बाद बेदखल परिवार परेशान है। उत्तम की हाल ही में सगाई हुई थी और अब उन्हें डर है कि उसके परिवार के खिलाफ कार्रवाई के कारण यह टूट सकती है। उत्तम ने बताया कि, शुरुआत में उसने ठेले पर आइसक्रीम बेची और पढ़ाई की। कुछ समय मजदूरी भी की। इसके बाद खुद की किराने की दुकान चलाई। अब वह मोबाइल की दुकान संचालित करता है। उसकी तरक्की गांव के कुछ दबंगों को पसंद नहीं आई और सामाजिक बैठक की। बिना किसी कारण के उसका समाजिक बहिष्कार कर दिया। जानकारी के मुताबिक, परिवार ने इस मामले को लेकर 16 लोगों के खिलाफ कलेक्टर और एसपी से शिकायत की है। इन लोगों ने उस बैठक में महत्वपूर्ण भूमिका निभाई थी, जिसमें उत्तम का परिवार सहित सामाजिक बहिष्कार करने का फरमान जारी हुआ था। पुलिस अधीक्षक (एसपी) शंकर बघेल ने कहा, 'हम घटना की जांच कर रहे हैं, जल्द ही कार्रवाई की जाएगी।' ये भी पढ़े... मौत के डर से 30 सालों से औरत बनकर रह रहा है ये शख्स, पत्नी के श्राप से मर गए परिवार के 14 लोग दो बार शादी करने के बावजूद तलाक लेना चाहते हैं डॉक्टर पति-पत्नी 104 साल के बुजुर्ग की मौत, एक घंटे बाद पत्नी ने भी दुनिया को कहा अलविदा Read the full article
