THE BILL TO AMEND THE POLICE ACT IS AN OUTRAGEOUS ATTEMPT TO TURN BARBADOS INTO A POLICE STATE
Tomorrow-- Wednesday the 31 st of January 2018 -- the Snate of Barbados will be considering a "Bill to amend the Police Act" that was laid in the House of Assembly by the Democratic Labour Party (DLP) Attorney General Adriel Brathwaite.
The main component of this Bill is a proposal to give the Commissioner of Police and the Attorney General the power-- by themselves-- to impose a two day "CURFEW" on any geographical area within our nation (or indeed across the ENTIRE island) if the Commissioner of Police considers that he "has received information or intelligence with regard to criminal activity in any area of Barbados, and it appears to him that due to the nature or extent of the criminal activity, that there are reasonable grounds to believe that in the interest of public safety, public order or for the purpose of preventing or detecting crime, it is necessary to do so". And once such a CURFEW is imposed, the Bill--if enacted into law -- would give the Police the right to : 1. Command all persons within the Curfew area to return to their homes or premises and remain indoors; 2. Command all businesses in the Curfew area to close and remain closed; 3. Command all social gatherings in the Curfew area to come to an end; 4. Search all premises (without any requirement to have a Search Warrant) once any Police officer has reasonable suspicion that any offence (no matter how minor or trivial) has been committed or is about to be committed in the said premises; 5. Stop and search any person (without any requirement to have a Search Warrant) once any Police officer has reasonable suspicion that any offence (no matter how minor or trivial) has been committed or is about to be about to be committed; 6. Stop and search any motor-vehicle (without any requirement to have a search Warrant) once any Police officer has reasonable suspicion that any offence (no matter how minor or trivial) has been committed or is about to be committed; and 7. Require any person within the Curfew area to remain stationary and to refrain from carrying out any activity. Furthermore, if the Police set up a so-called "Cordon" in any part of Barbados--either generally or under a Curfew-- they also have the power to oblige any person within the cordon area to answer questions put to them by the Police, and to perform any actions that the Police believe are reasonably required in order to preserve the peace or to prevent any contravention of the law. The Bill therefore proposes to give the Police powers over the Barbadian citizen's Constitutionally guaranteed rights to liberty, security of the person, and protection of the privacy of his home and other property, that are way in excess of the powers that the Police currently generally possess! Under our current Constitutional arrangements, the only way that the Police can acquire the powers that this Bill proposes to give them is if "a period of public emergency" is declared under Section 25 of our Barbados Constitution. In a similar vein to this Bill, Section 25 (2) (b) of the Constitution provides that one of the grounds on which a "period of public emergency" may be declared is if "action has been taken by any person of such a nature and on so extensive a scale as to be likely to endanger the public safety...." HOWEVER, the BIG DIFFERENCE between the declaration of a "period of public emergency" under Section 25 of the Constitution and the declaration of a Curfew under this Democratic Labour Party (DLP) Bill is that in the former case (under the Constitution), the special regime can only be established by way of a vote in BOTH the House of Assembly and the Senate of two thirds of the members of these two houses of Parliament, or by way of a Proclamation of the Governor General, to be followed by Orders made by the entire Cabinet of Barbados-- Orders that then have to be laid before Parliament, while in the latter case (under the DLP Bill), the decision is totally left to the Attorney General and the Commissioner of Police, with no need for Parliamentary approval. I can't speak for the rest of my fellow Barbadians, but certainly I, as a Citizen of Barbados, do not feel comfortable with such power being placed in the hands of the Attorney General and the Commissioner of Police! As far as I am concerned, if such sweeping powers are to be given to the Police they should only be given in circumstances where the elected political representatives of the people-- meeting in a session of the House of Assembly-- give due consideration to the reasons being put forward for the imposition of a Curfew and the granting of draconian Police powers, and signify their approval by a majority vote. I would also like my fellow Barbadian citizens to know that this is not the only outrageous proposal contained in this DLP Bill! Just to give one other example:- This Bill is proposing that anyone found guilty of using "abusive or insulting language" to a Police Officer who is carrying out duties during the course of implementing a so-called "cordon"in any part of Barbados, or during the course of a Curfew, is liable "on conviction by a court of summary jurisdiction to a fine of $10,000 or to imprisonment for a term of 3 years or to both, but if the magistrate is of the opinion that the matter is a fit subject for a prosecution by indictment, he shall commit the offender to stand trial at the High Court sitting for the trial of criminal offences." (PLEASE SEE SECTION 5 OF THE BILL) If this is not evidence of a burgeoning Police State then I don't know what is. It is truly scandalous that the Parliament of Barbados is on the verge of enacting into law such a draconian Bill that subverts so many of the freedoms and rights of the Barbadian people WITH LITTLE OR NO PUBLIC DISCUSSION! I hereby call upon and encourage the seven Independent Senators of Barbados to take upon themselves the role of "tribunes" of the Barbadian people-- to be the voice and conscience of the Barbadian people in tomorrow's Senate debate, and to insist that this Bill not be passed, and that it be put through a process of public scrutiny and discussion, and ultimately, of amendment. SCABIES EMERGENCY MEETING - Health and security officials were yesterday evening involved in an emergency meeting at Government headquarters after a Nigerian student tested positive for the contagious skin infection, scabies. There are two additional suspected cases, said attorney-at-law David Comissiong, who is close to the matter. The meeting also involved Acting Commissioner of Police Tyrone Griffith, Chief Immigration Officer Erene Griffith, as well as representatives of the Defence Force. After emerging from the meeting, the police chief told Barbados TODAY, “The Nigerians are visitors to our shores and as a result we have to look after their security and ensure that they are safe.” The meeting was called following a survey by health officials today at the Casa Grande Hotel, where the Nigerians are staying, Comissiong said. Chief Medical Officer Dr Joy St John has refused to comment on the matter. When contacted about reports that at least one Nigerian had been infected, she would only say, “We did not release that information and I certainly am not speaking on this matter.”
NIGERIANS QUARANTINED - THE 90 Nigerian students are to be quarantined after one of them tested positive for scabies, a contagious skin infection. The decision was made yesterday evening after a high-level meeting chaired by Prime Minister Freundel Stuart at Government Headquarters, Bay Street, St Michael. Reports are that officials are exploring the possibility of keeping the students at the Barbados Defence Force. Attending the meeting were Acting Commissioner of Police Tyrone Griffith, Defence Force Chief of Staff Lieutenant Colonel Alvin Quintyne and senior officials of the Ministry of Health. Hours earlier, a team of about 40 officials, including doctors and health inspectors, descended on Casa Grande Hotel at Oldbury, St Philip, where the students have been housed for the past two weeks.
BARBADOS COMMUNITY COLLEGE NOT READY FOR NIGERIANS - THE BARBADOS Community College (BCC) is not in a state of readiness to accept the 90 Nigerian students in the next ten days. The SUNDAY SUN was reliably informed that application forms were being prepared only on Friday and that there were no available classrooms, furniture or even additional tutors in place to accommodate the large group, who arrived in Barbados two weeks ago to undertake hospitality and agriculture studies for nine months. This state of affairs was also communicated by the chairman of the BCC board, Stephen Broomes, in a letter last Tuesday to board members as well as principal Dr Gladstone Best and other concerned parties.
BAJANS PAYING THE MOST FOR GAS - BARBADIANS PAY THE highest prices for gasoline and diesel in the Eastern Caribbean.What’s more, while the Eastern Caribbean territories have begun to reap the benefits from the dramatic drop of more than US$50 a barrel in crude oil prices on the world market since last June, Barbadians have only received a cut of 36 cents in prices at the pump since last July. A comparative analysis of prices paid by the countries in the Eastern Caribbean Currency Union (ECCU) – Anguilla, Antigua and Barbuda, Dominica, Grenada, Montserrat, St Kitts and Nevis, St Lucia, St Vincent and the Grenadines – and Barbados show that Barbadians pay between $1.49 and 65 cents more for a litre of gasoline, and between 51 cents and five cents more for diesel.
REGIONAL TRAVEL TOO EXPENSIVE - Parliamentary Secretary in the Ministry of Tourism Senator Irene Sandiford-Garner is not expecting any improvement in the number of visitors coming to Barbados from the CARICOM market any time soon. And she blamed high airfares and a lack of competition for that, as well as for the falloff in arrivals last year.For the first nine months of 2014, visitor arrivals from the CARICOM dipped 10.8 per cent, compared to a decrease of 8.3 per cent from Europe, 3.5 per cent from Canada and 2.7 per cent from the United States.
COURT RULES AGAINST SPEAKER OF HOUSE -QUEEN’S COUNSEL Michael Carrington, who is also Speaker of the House of Assembly, has run into hot water with one of his clients.Carrington, a practising attorney-at-law, has been ordered by the High Court to surrender nearly a quarter-million dollars to John Griffiths, funds received and withheld over two years ago from the sale of a property as well as various bank deposits. Justice Jacqueline Cornelius also ruled last month that Carrington render an account of all sums belonging to the particular estate within 28 days. He was also ordered to “pay interest at the rate of per annum” from May 13 until the entire sum is paid, and legal costs of over $7 700 incurred by Griffiths.
NUPW READY TO MARCH - IT’S NEVER TOO late for justice. That’s why the National Union of Public Workers (NUPW) will be pressing ahead with their protest march in support of retrenched National Conservation Commission (NCC) workers on Tuesday, despite a planned meeting with Minister of Labour Senator Dr Esther Byer tomorrow. Acting NUPW general secretary Roslyn Smith made it clear yesterday that the march, to protest the near year-long delay in getting the former workers’ case heard by the Employment Rights Tribunal, was going ahead in The City to make their point. While preparing placards for the march at the NUPW’s Dalkeith Road, St Michael headquarters, she said Byer requested the meeting to deal with the Employment Rights Act and there was no mention of the union’s planned protest.
NUPW ROUTE CHANGE - The National Union of Public Workers (NUPW) has been forced to change the route for its protest march scheduled for Tuesday in support of retrenched National Conservation Commission workers. Acting General Secretary Roslyn Smith stated they have been informed that the previous route would have taken protestors too close to the Parliament building, in contravention of the law. As a result, the demonstrators will now proceed from Queen’s Park, travel along Halls Road, Roebuck Street, turn right onto Pinfold Street, left onto Magazine Lane, right onto James Street, onto Tudor Street, Broad Street, turn left onto Prince Williams Street, turn right onto Swan Street, onto Roebuck Street, right onto Crumpton Street before returning to Queen’s Park.
TEACHERS UNIONS TO MEET - In what is to be the first collaboration since the Louis Lynch saga, the executives of the Barbados Union of Teachers (BUT) and the Barbados Secondary Teachers’ Union (BSTU) will meet tomorrow at the BSTU’s Belleville, St Michael headquarters at 3:30 p.m. Given the support shown by BSTU president Mary Redman following what was deemed a “covert” threat by Minister of Education Ronald Jones in relation to the general meeting called by the BUT last Tuesday, BUT president Pedro Shepherd stated he was “excitingly” looking forward to meeting with the BSTU.
DIGITAL EDGE -Barbados has what it takes to exploit “several emerging trends” and grow its international business and financial services sector. Donald Oliver, a former Canadian senator who is involved in several businesses, thinks the island should pursue these “vast opportunities” this year. Oliver, who was one of the several experts in Barbados last September to participate in an international conference hosted by Invest Barbados, said in the current fast moving digital age Barbados was “a unique and quietly successful international financial centre”. But he said Barbados needed to be wary of international efforts that could negatively affect the advancement of such domiciles, including various Organisation for Economic Cooperation and Development (OECD) initiatives.
FLOWER SHOW - A vibrant display of beauty and artistic talent is on show at the St Peter Parish Church. It is the 14th annual staging of the church’s Flower Show and Garden Festival being held under the theme Nature’s Bounty. Between 30 and 40 floral arrangements are artfully displayed on both floors of the church, while residents sell locally made jewelry, potted plants and other items on the church grounds.
FORMER JUNIOR CALYPSO MONARCH CHARGED - The 2007 Junior Calypso Monarch, who was shot by lawmen during a chase this week, is now facing five charges, including assaulting two police officers. Rico Gaskin, 23, of Lowthers Hill, St Patricks has been charged with two counts of endangering life, two counts of assault and one count of criminal damage. Gaskin is accused of assaulting the lawmen two days ago while at Farnums Land, Chapman Lane, St Michael. During the chase, he was shot in his shoulder.Additionally, he is accused of shooting at two men who were in a car at Cavans Lane, Bridgetown, in November 2014. The car was damaged during the incident. The accused is expected to appear at the District ‘A’ Magistrate’s Court on Monday.

YOUTH NOMINATE KARTEL - Kartel, who is serving a life sentence for his role in the disappearance of Clive 'Lizard' Campbell, was nominated for Favourite Local Chart-Topping Song, Favourite Local Artiste of the Year, Favourite Dancehall Artiste, Hottest Summer Song of the Year, and Favourite Musical Collaboration. The deejay earned the biggest cheer of the evening with his nomination in the Favourite Local Chart-Topping Song category with Miami Vice Episode. Kartel (given name Adidja Palmer) has been in jail since September 2012. He is known for hits including Clarks (featuring Popcaan), Emergency and Romping Shop (done with Spice). His album, Kartel Forever Trilogy, was released last September. Karen Clarke, CEO of An Elegant Affair Events -- creators of the eight-year-old YVAs, told the Jamaica Observer the nominations represent the data collected from 14- to 24-year-olds islandwide. "The YVAs are an unbiased voice of the youth of Jamaica," she told the Observer.
JENNIFER HUDSON T DEBUT ON BROADWAY - Jennifer Hudson will make her Broadway debut in the fall when the musical The Color Purple returns. The Grammy, Oscar and Golden Globe winner will play Shug Avery, a sultry blues singer, in the production directed and designed by John Doyle, who received a director's Tony in 2006 for his own Broadway debut, Sweeney Todd. It's Hudson's first musical theater role since her award-winning turn in the 2006 film Dreamgirls. Further casting and a specific theater were not announced in a statement released Friday by the show's publicists.
