Q: I paid a lawyer $14.000 to help me with my foreclosure. I had a cruel loan, a subprime, and when the economy tanked so did my business. I paid around $300.000 for my home, it is probably worth $130.000 now. My lawyer kept me in my house, but did nothing else. I let him go two years ago and my case has been inactive for two years. Now there is a case management coming up in June. I am tired of fighting this. How do I let this house go without having to go broke with lawyer fees again? Is bankruptcy my only option? Can my HOA bill me for unpaid fees which were due prior to chapter 7, if my bank decides to let me keep my house?
Q: I owed about 24 months of association fees before chapter 7 been discharged and another 12 after. Now my bank decided to let me keep the house. The HOA attorney is trying to collect on everything. What am I liable for? What kind of payment plan is usually acceptable?
A: While you are not personally liable for the dues that accrued before you filed, you are personally liable for the ones that accrued after filing. The HOA can still foreclose on the property for the entire debt because it "runs with the land." They have to be careful how they word the foreclosure complaint to make it clear they are not holding you personally liable for the pre-petition dues.
You should consult with a bankruptcy attorney to make sure the HOA did not violate the bankruptcy code, the Fair Debt Collection Practices Act, or the Florida Consumer Credit Practices Act.
