A judge ordered the reinstatement of a video game developer after he was fired as part of a scheme cooked up by a CEO using ChatGPT. Facing the possibility of paying out a massive bonus to the developer of Subnautica2, the CEO of publisher Krafton used ChatGPT to create a plan to take over the development studio and force out its founder, according to court records.
The Monday ruling details the bizarre story. Unknown Worlds Entertainment is the studio behind the 2018 underwater survival game Subnautica. The company has since been working on the sequel, Subnautica 2. In 2021, South Korean publisher Krafton bought Unknown Worlds Entertainment for $500 million and promised to pay out another $250 million if Subnautica 2 sold well enough.
Kraftonâs internal sales projections for Subnautica 2 looked great, and looked like it would be on the hook for the additional $250 million. In an attempt to avoid paying this, Krafton CEO Changhan Kim turned to ChatGPT for help avoiding paying the developers the $250 million bonus. âAs Unknown Worlds prepared to release its hotly anticipated sequel, Subnautica 2, the partiesâ relationship fractured,â the court decision said. âFearing he had agreed to a âpushoverâ contract, Kraftonâs CEO consulted an artificial intelligence chatbot to contrive a corporate âtakeoverâ strategy.â
Kim partnered with Krafton Head of Corporate Development Maria Park and the companyâs legal team to work out options. He toyed with finding a reason to fire the founders. According to court records, Park pinged Kim on Slack and told him that attempting to avoid paying the bonus would be legally risky. âHi CEO . . . it seems to be highly likely that the earn-out will still be paid if the sales goal is achieved regardless of the dismissal with cause,â the Slack message said according to court records. âTherefore, there isnât much that we can practically gain other than punishment with a simple dismissal alone, whereas I am worried that we may be exposed to lawsuit and reputation risk.â
But the CEO would not accept defeat. âAnd so Kim turned to ChatGPT for help,â court records said. âWhen the AI chatbot responded that the earnout would be âdifficult to cancel,â Kim complained to Park that the [payout] was a âcontract under which we can only be dragged around.ââ
Kim pressed the chatbot for an answer. âAt ChatGPTâs suggestion, Kim formed an internal task force, dubbed âProject X.â The task forceâs mandate was to either negotiate a âdealâ on the earnout or execute a âTake Overâ of Unknown Worlds. They looked to buy time,â court records said. âKim sought ChatGPTâs counsel on how to proceed if Krafton failed to reach a deal with Unknown Worlds on the earnout. The AI chatbot prepared a âResponse Strategyâ to a âNo-Dealâ Scenario.â
This was a piece of ChatGPTâs âProject Xâ for Krafton:
âa. Preemptive Framing - Repeat that protecting quality and fan trust is the highest priority, undermine the âLarge Corporation VS. Indieâ framing b. Securing Control Points - * Lock down Steam/console publishing rights and access rights over code/build pipeline through both legal and technical aspects. * For the earn-out freeze, keep room for negotiations through provision stating âimmediate removal if specific development results are achievedâ a. Systematic materials for legal defense - Prepare contract interpretation memorandums, log all communications, seek external consultation b. Team retention - Operation of retention packages for key personnel and rapid backfill pipelines in anticipation of resignation/departure scenarios c. Two handed strategy - Create a structure that allows for both hardball (Legal+ Finance) and softball (Support/Incentives) approaches so moderate factions within Unknown Worlds can push for compromise.â
Kim followed ChatGPTâs advice rather than his lawyersâ advice, according to the court records. The first step was posting a message on Subanuticaâs website to get fans on his side. According to court documents, Kim said the goal of the message was to âsecure public support from fans and legal validation of our legitimacy.â He then suggested that ChatGPT write it for him. It achieved the opposite of his intended goal. Fans found the message bizarre and worried about the future of the game. Those fears were compounded when Kim fired the gameâs original creators and entered into a legal battle with them.
The legal battle is ongoing, but Kim looks set to lose. The judge has ordered he reinstate the fired developers and has exposed the CEOâs flailing use of ChatGPT. Krafton told Kotaku that it was âevaluating its optionsâ regarding the ruling and that it âputs players at the heart of every decision

but the game also lets you play durge as a person who was pretty deeply unhappy as Bhaalâs chosen. just a deeply, deeply unhappy person who was not enjoying their life. which is a funny way for someone who supposedly loves death and murder so much to feel about a life that was brimful of both of their favorite things, yeah?
anyway. this is why I think durge who never had a choice in becoming durge doesnât necessarily have to be quite so delighted by murder per se.
I think Tavia is fascinated by transformation. I think this is also what Orin is obsessed with, fwiw, which would go a lot further towards explaining her obsession with remaking her victims into new creations after they die. I donât think where she gets off is the killing and the butchering in and of itself â Tavia doesnât, I mean, although I suspect it is also true of Orin.
All that violence? All that butchery? I think thatâs something that a bhaalspawn is going to sucked into no matter what they want, since Bhaal uses his offspring as puppets. I think every bhaalspawn has to find some way to cope with that. Saarevok, for example, seems to cope via the Cold Professionalism route. He understands that there is no freedom from the death father. There is only the possibility of surviving what the lord of murder requires of his children by submitting yourself to his requirements with cool determination. What is thrust upon you may destroy you no matter what, but it will without question destroy you should you try to resist. So why resist?
Orin copes by making her murders into art, literally. Her victims arenât victims, theyâre material, raw clay that can be glorified through transformation, rude matter that can be shaped into something greater, something more.
Tavia â canon durge, really â becomes the dark urge as a result of a process of transformation that happens to her. Durge canonically starts having murder sprees during blackouts. They do not have any control. They do not have a choice. Transformation is a brutality that comes over you from the outside. It knocks you flat and turns you into something else, no matter if you want it or not. The experience of change, of becoming, is itself traumatic. I think at a very fundamental level what Tavia is doing when she kills and even more importantly when she engages in freakish, perverted indulgences with dead bodies â from the almost normal like autopsy to the fully bizarre like necrophilia and cannibalism â is recreating in some semi-controllable way the model of transformation she experienced herself. I think sheâs trying to understand it.
Which, to return to an earlier point, is also very much what I think Orin is doing when she makes corpses into art projects. Orinâs most important art project is herself. She labors under the comforting delusion that if she finally perfects making the piece of art that she herself is supposed to be, all the suffering of her existence will end. Her father(s) will love her. She will be a perfect creature, and she will be rewarded with praise and acknowledgment and love. The murders are a means to an end, and the end sheâs seeking is to be treated with the kind of care and appreciation she never had as a small child. Whatâs tragic about her is she still believes that the father(s) she wants to please would ever have any desire to give her what she wants.
I donât think Tavia is operating under the misapprehension that Bhaal would ever see her as anything other than a tool to be used until itâs used up. I do, however, think that she chooses to continue to believe that she can find answers outside herself that will alleviate the pain of having been remade into something monstrous⊠because choosing to willfully believe that there are answers out there, which is at bottom a belief that there might be a way out somewhere out there for her, is maybe the only thing that keeps her going. (Which, really, actually is the exact same thing that is going on with Orin â they just conceive of a way out in very different ways. For Orin, the way out is finally feeling like daddy loves her. For Tavia, the way out is finally feeling like everything that she is and that sheâs experienced make sense and she doesnât have to be bothered by any of it anymore.)
And I think that even after she wakes up after the nautiloid, even after she gets the opportunity to become something sheâs choosing to become, even when she starts to feel free to resist what Bhaal wants her to be⊠she still has a very similar to corpses as she had while she was the head of the temple. Death is still the ultimate transformation. Dead bodies are the site of the most fundamental, most totalizing, most fascinating transformation possible. The answers, all the answers, are in there somewhere. How strange. How hideous. How beautiful. How romantic. The way out is somewhere in there.
So even as a resist durge⊠she is definitely still getting way too intimate with carrion, particularly when sheâs feeling emotionally wounded.
Which is why when Astarion and Shadowheart are flirting like crazy on the risen road even though she thought she was his special snack pack, she goes and sits down with a corpse pile and starts draping herself in viscera and chewing on a severed foot. Absolutely baby-with-a-pacifier behavior.
additionally. also. thing number three: the more I think about it the more I actually really like the idea that Gortash knew Durge was in the moonrise dungeons the whole time. Visited them in the lab. Watched Kressa work. Hoped the tadpole would fix them. Ketheric gives him little presents out of guilt and to try and get his mind off the zombie in the basement. Not that Ketheric really cares about the plan or feels bad about helping Orin hurt Durge per se, but he knows what Gort is going through and feels a little bad about inflicting that on Gort. Not that Gort knows Ketheric helped with it. Sometimes Gort goes down into the oubliette and watches mindless, feral Durge thrash and howl and try to kill anything that gets in spitting distance. Just sits there and watches. I donât know that it makes sense, like I donât know that it works timeline-wise, but itâs sooooooo warped so I like it lol

Durge is obviously not really with it most of the game so theyâre not really Bhaalâs chosen but the stupid butler is still giving them horrid little presents all game right???? which implies the butler is also not really devoted to Orin either so like⊠imma go out in a limb here and say actually bhaal doesnât even really HAVE a chosen during the game. dead three plan is hopeless from the word go. Bhaal doesnât even have a chosen!!! Ketheric doesnât even give a fuck. Gortash is the only bitch on the block trying to do his job and Bane isnât even fucking invested in the outcome, he barely gives Gort any help. what a mess!
ok so like the thing about Tavia is that she does want what those two doves bathing in a stream have but she experiences that when Astarion is biting her all over like an evil little cat and drinking all her blood. because she is a freak.
At some point I got curious and tried turning down every single one of Gortash's offers - and he somehow had a counterargument for all of them, which honestly cracked me up. This man does not know how to give up xD
