FCSA Accredited Umbrella Accused of Withholding Thousands from Contractors

An unnamed umbrella company was recently accused of withholding thousands of pounds of holiday pay from its contractors on BBC Radio 4’s Moneybox programme. The umbrella company, whilst not named by the programme was identified as a member of the Freelancer and Contractor Services Association (FCSA) and is claimed to have withheld around £6,000 in holiday pay from a contractor. Court of Appeal Ruling Grants Justice for Contractors' Holiday Pay

On 1st February 2022 the Court of Appeal in the case of Gary Smith V Pimlico Plumber Limited has provided a huge victory for umbrella contractors. The primary focus of Contractor Voice has been for contractors to be treated fairly and legally in relation to FCSA Holiday Pay, exposing the ways in which some umbrellas have tried to avoid paying, as we explained on our Holiday Pay page. "Steve," an anonymous contractor and software developer, shared on the program that he and fellow colleagues faced similar treatment. A spokesperson for ADVANCE said: ‘We welcome the FCSA’s statement today which acknowledges that the changes it previously proposed to its code surrounding holiday pay would have mandated its members to act unlawfully, in breach of the Working Time Regulation. ‘Although we understand and agree that the so-called ‘use it or lose it’ holiday pay situation is unsatisfactory, we were put in an invidious position that meant if we had accepted the changes to the FCSA’s code we would have been required to break the law. Other members also voiced their concerns that the suggested new code could not lawfully go ahead. ‘We want to make it absolutely clear that we do agree that the rules and regulations on holiday pay need urgent reform. We fully support the FCSA in lobbying the Government to make changes to the law that will resolve this situation to the satisfaction of the workers.

What difference does choosing an accredited over a non accredited Umbrella company make and why does your agency have a PSL? We answer all.

This always comes out to be a major surprise for a lot of people, after all FCSA and Professional Passport sound so official but actually there is no difference between being accredited and non accredited. There is no official body or accreditation for Umbrella Companies, HMRC will never endorse any FCSA Umbrella Company no matter what their accreditation status, they are explicit on this.
