genuine question but can i ask why restricting minors from social media is such a bad thing? im obviously not as educated so im viewing this surface level, but wouldnt this theoretically lead to better overall outcomes? i feel like social media has done a decent amount more harm than good, no?
the reason why it's bad because it will make everyone have to verify their age to use social media which can create bad privacy risks such as having their ids exposed on the internet, putting people at risk for identity theft.
no, the reason it's bad is that social media is a huge part of how people communicate with friends and family, express their ideas and beliefs, form and sustain community, develop individual and group identities, and participate in democratic society, and children have the right to do all of those things because they are human beings.
these laws are not bad (just) because of their side effects, they are bad because their stated goals are immoral.
It would be one thing to try to regulate what the companies do that's harmful: infinite scroll, surveillance-driven algorithms, media autoplay, lack of meaningful moderation, etc. That would put the onus on the companies to actually change the things about their product which are harmful to users of any age and which intrude upon the privacy of all users.
This just gates communication to an age bracket, doesn't actually change the things about social media which are harmful, and puts the weight of this change on the most marginalized segments of the social media population.
And, if you can believe it, the governor's "counter proposal" is worse. Evan Greer's BlueSky thread covers it pretty well, but a couple of, uh, highlights:
Requires establishing an exact age for every social media user, not just minors, which means uploading IDs (and watch how fast the feds come after THOSE records, suppressing speech & using it to look for more people for ICE to haul off)
Requires a company to shut down a user's account within one hour of request by someone claiming to be a parent (a bonanza for Tumblr-style bully-brigadiers, never mind "what happens when there's a custody dispute? Are we uploading birth certificates now?")
This will be nearly impossible for big companies to deal with, but flat out unworkable for any company that doesn't have basically unlimited money. Goodbye, Tumblr! Goodbye, Pillowfort! Farewell, BlueSky! There will never be another small or startup social media company (unless it's coming from the same 5 people who already own everything) bc this alone will be such a money sink that it'll be impossible
You shouldn't have to give up your basic rights to privacy to access what is now a default mode of human communication. This is functionally like requiring ID to go to a public park or to walk down a public street, especially bc so many governmental bodies communicate through social media and don't update their web presence "because you can just go to our Facebook/X/BlueSky/etc."
Massholes, yell at your senators. The bill you're mad about is S.335/H.5366 (afaict).
