As he makes clear, “For nearly two hundred years, mineral resources in the United States were developed with minimal controls. This was for two, interlinked reasons. Firstly, the impact of mining on the environment was not commonly understood, and secondly, the technology was insufficiently developed to measure, control and protect any damage caused by mining operations. In particular, the impact on air quality by particulate matter was widely misunderstood,” he recalls, adding, “Particulate matter is caused when detritus from surface mining is collected or returned to the mine. This necessarily means vegetation is stripped from the surrounding area leaving the topsoil open to the weather. This further hastens the release of particulates by the wind or transport operating around the mine. These particulates often contain residues of lead, arsenic or cadmium, which are then absorbed into the skin or internal organs – particularly the lungs.

According to Jack Hagewood, water pollution is another factor that has now been addressed. “Mining operations cause metal contamination and a significant increase in sediment levels in rivers and waterways. These sediments, which are frequently caused by soil erosion and disused mines, effectively isolate the riverbed from fresh or untainted water. This has had a marked effect on spawning sites, domestic water usage, and irrigation. Acid Mine Drainage (AMD) is another severe potential problem, caused by increased acid levels in the surrounding water supplies. This often leads to the destruction of organisms and introduces huge corrosive levels injurious to any metal products and effectively causes the water to become undrinkable.”

For Jack Hagewood, excellence in engineering management means not only having a thorough knowledge of geology, chemistry, engineering, and environmental concerns, but must also include at least an understanding of some of the main legislative actions and regulations governing the operation of a mine.

For example, one of the most important of the federal laws and regulations that have had a major effect on the industry is the Comprehensive Environmental Response, Compensation, And Liability Act (CERCLA) of 1980. Usually known as the 'Superfund,' the law demands that mining operators immediately report the release of dangerous, toxic substances into the environment. Furthermore, it also requires the wholesale cleaning of the site where these toxic substances are reported to have been found. In essence, the Superfund program was initiated to locate, investigate, and erase the worst of the unfortunately many hazardous sites still to be found across the United States. Indeed, the program is currently being implemented by the US Environmental Protection Agency (EPA) to clean mineral-related pollution at literally hundreds of mines.

Another extremely important piece of legislation to be enacted was the Federal Water Pollution Control Act, normally spoken of as the Clean Water Act, which came into effect in 1977. Another regulation, The Resource Conservation and Recovery Act (RCRA), which was enacted in 1976, regulates the generation, storage, and disposal of solid waste and hazardous waste. To enable this to work effectively, mines were instructed to to use a "cradle-to-grave" system, meaning that all waste is supervised from the point of its generation to its disposal. The National Environmental Policy Act (NEPA), enacted in 1970, stipulates that all federal agencies are required to prepare an Environmental Impact Statement (EIS) for all major actions that could have a significant effect on the environment. These procedures primarily exist to ensure that environmental information is available to public officials and citizens before actions are taken. NEPA applies to all mining operations that require federal sanctions.

As Jack Hagewood points out, the European Union has also developed a set of environmental directives that have had a significant effect on the mining industries of each of the member nations. Each country's environmental laws derive in full from these directives. Among the key directives are the Environmental Impact Assessment Directive (similar to the EIS requirements of the United States), the Water Framework Directive (addresses concerns similar to those of the U.S. Clean Water Act), and the Waste Framework, Hazardous Waste, and Landfill Directives (all address concerns similar to those of the RCRA).

All risks should be assessed, no matter their likelihood. As a manger, Mr. Hagewood has never compromised the safety of his workers just to meet a project deadline or to avoid going over budget.

He also made sure that every member of his team always wore the proper safety equipment, including helmets, safety glasses, and gloves. As a supervisor, he instructed his team on safety protocol, and acted as an overseer to confirm that they followed these instructions with no exceptions. Mr. Hagewood’s attention to detail and commitment to his role as a leader ensured that all members of his team always performed their duties in as safe of an environment as possible. Indeed, as Jack Hagewood indicates, “Poor ventilation is one of the greatest concerns for miners. Going beneath the earth’s surface exposes miners to various gases, substances, and chemicals that may be harmful. Some of these may cause minor illness or injury, while others can poison workers and limit oxygen supply, resulting in death by asphyxiation. Another common accident in the mining industry is the caving in of the walls and ceilings of underground mineshafts. This occurs when a site is not properly secured, or the mineshafts were excavated too deeply, weakening the walls and ceilings,” warns Jack Hagewood.

As a mining expert with more than 25 years experience in the industry, he is accustomed to reading about - and witnessing – suffering. However, the deaths of the nine people, six miners and three rescue rescue workers, over those three fateful days in August, 2007, was an event of such unparalled horror that Jack Hagewood believes it would be an impossibility for him to ever erase the thought of their despair and anguish. So what exactly took place at Crandall Canyon? Jack Hagewood takes up the story. “A massive structural failure caused the a chamber to collapse. Six miners were trapped more than 1,500 feet underground. Naturally, rescue operations were started immediately, but these were hampered due to a huge coal obstruction, which was estimated to take between two and three weeks to clear. “It was decided to drill a number of bore holes to both locate the miners and to lower microphones to their position. Over the next few days, the rescue teams continued to attempt to breach the blockade. Tragically, the mine collapsed again and three rescue workers died. All further efforts to rescue the miners were abandoned.”

However, there was at least one positive outcome from the disaster -  excellence in engineering management came to be seen as crucial in the prevention of such disasters.“Various investigatory bodies were set up to assess the efficiency of inspections into the safety of US coal mines. It reported that the overwhelming weight of evidence suggested severe shortcomings, concluding that the State of Utah does about as little as any other state to promote safety. Further, it stated that there should be more stringent safety oversights, more effective use of technology, and clear lines of command when it came to emergency response.” It should perhaps be also noted that US mine safety regulators also drew attention to the fact that more than one in seven of the entire number of mines in the US had failed to be regulated. Jack Hagewood believes that US regulators have learned their lesson – particularly with regard to implementing enhanced communication technologies to assist post-accident communications. It also drew attention to the need for utilizing wireless systems and electronic tracking. However, as Jack Hagewood says, “A real worry is that as coal demand increases, investment in infrastructure and maintenance is falling to one side.” Only time will tell if the tragic circumstances in Crandall Canyon will lead to lessons being learned and safety measures improved.
