Many couples become engaged with expectations of what married life will be like. A good way to prepare for marriage is to ask your partner what marriage means to them - compare your thoughts! Legal Overview of Marriage: A marriage is an interpersonal relationship with social, or religious recognition, usually intimate and sexual, and mostly created as a social contract or bond between two persons of usually opposite gender. In some countries a governmental recognition is either desired or required. In the United States for example a marriage license is required from a local authority that records two peoples and checks if the two are qualified to celebrate the marriage. The most frequently occurring form of marriage unites a man and a woman as husband and wife. Other forms of marriage also exist; for example, polygamy, in which a person takes more than one spouse, is common in many societies. Beginning in 2001, the legal concept of marriage has been expanded to include same-sex marriage in some jurisdictions of a few countries like Canada, USA and a few in EU. The reasons people marry vary widely, but usually include one or more of the following: legal, social and economic stability; the formation of a family unit; procreation and the education and nurturing of children; legitimizing sexual relations; public declaration of love. A marriage is often declared by a wedding ceremony, which may be performed by a religious officiator, through a similar government-sanctioned secular officiator, or (in weddings that have no church or state affiliation) by a trusted friend of the wedding participants. The act of marriage usually creates obligations between the individuals involved, and in many societies, their extended families.

1. DO allow yourself enough time to make one of your biggest life-altering decisions. Ask yourself why now and why with this person? DO discuss having children and if this is something as a couple you want to do. Also, discuss about how many children you'll plan to have and when you'll have them. What parenting practices will you adopt to raise your children? Who will stay at home or will both parties work? You should also define parenting roles as individuals and as a couple. 3. DO create a financial plan together. A lot of times people avoid talking about this, but you need to define financial goals and expectations beforehand. Don't just know how much your future spouse makes, but know the whole picture. Who will be in charge of balancing the checkbook? Will you join your accounts or will they be separate? What are your top financial goals together? People have different spending habits and different financial styles that are often influenced by family. What happens if one spouse starts spending excessively? How will this be handled? Speak with a financial planner and retain one together. 4. DO compare personal goals versus goals as a couple and the obstacles that may arise. If one party wants to move to California for a job promotion and the other desires to live near family in Florida, that's something to discuss now. How will you as a couple make life-altering decisions on which you may not agree? Surely, not all your goals will match that of your partner, but there needs to be decision-making beforehand on how to handle these differences. If one party longs to have children shortly after marrying, while the other wants to wait to start a family and hopes to attend graduate school, this could create tension in the marriage and lead down the road to separation or divorce. 5. DO decide on how to handle disputes. Conflict will arise in any relationship; it's a normal indicator of self expression and thought. Deciding on how to handle conflict will prevent big disputes and arguments that might be detrimental to the relationship. Decide ahead of time the rules for arguing and the limits. Set rules involving communication like no "walk always" or "put downs". This will allow you and your future spouse to effectively handle conflict when it arises, and surely it will. Also, agree to not let the little things get too big.

Rights and responsibilities of marriages in the United States According to the United States Government Accountability Office (GAO), there are over a thousand federal laws that treat married people differently from single people. It should be noted that these rights and responsibilities apply only to male-female married couples, as the 1996 Defense of Marriage Act (DOMA) defines marriage as between a man and a woman and thus bars Same-sex couples from receiving any federal recognition of same sex marriage or conveyance of marriage benefits to same sex couples through federal marriage law. Prior to the enactment of DOMA, the General Accounting Office (as the GAO was then called) identified 1,049 federal statutory provisions in which benefits, rights, and privileges are contingent on marital status or in which marital status is a factor. An update was published in 2004 by the GAO covering the period between September 21, 1996 (when DOMA was signed into law) and December 31, 2003. The update identified 120 new statutory provisions involving marital status, and 31 statutory provisions involving marital status repealed or amended in such a way as to eliminate marital status as a factor. continued commissary privileges o per diem payment to spouse for federal civil service employees when relocating o Indian Health Service care for spouses of Native Americans (in some circumstances) o sponsor husband/wife for immigration benefits * Larger benefits under some programs if married, including: o veteran's disability o Supplemental Security Income o disability payments for federal employees o medicaid o property tax exemption for homes of totally disabled veterans o income tax deductions, credits, rates exemption, and estimates * Joint and family-related rights: o joint filing of bankruptcy permitted o joint parenting rights, such as access to children's school records o family visitation rights for the spouse and non-biological children, such as to visit a spouse in a hospital or prison o next-of-kin status for emergency medical decisions or filing wrongful death claims o custodial rights to children, shared property, child support, and alimony after divorce o domestic violence intervention o access to "family only" services, such as reduced rate memberships to clubs & organizations or residency in certain neighborhoods * Preferential hiring for spouses of veterans in government jobs * Tax-free transfer of property between spouses (including on death) and exemption from "due-on-sale" clauses. * Special consideration to spouses of citizens and resident aliens * Spouse's flower sales count towards meeting the eligibility for Fresh Cut Flowers and Fresh Cut Greens Promotion and Information Act * Threats against spouses of various federal employees is a federal crime * Right to continue living on land purchased from spouse by National Park Service when easement granted to spouse * Court notice of probate proceedings * Domestic violence protection orders * Existing homestead lease continuation of rights * Regulation of condominium sales to owner-occupants exemption * Funeral and bereavement leave * Joint adoption and foster care * Joint tax filing * Insurance licenses, coverage, eligibility, and benefits organization of mutual benefits society * Legal status with stepchildren * Making spousal medical decisions * Spousal non-resident tuition deferential waiver * Permission to make funeral arrangements for a deceased spouse, including burial or cremation * Right of survivorship of custodial trust * Right to change surname upon marriage * Right to enter into prenuptial agreement * Right to inheritance of property * Spousal privilege and confidential marriage communications MarriagePartner.com Responsibilities * Spousal income and assets are counted in determining need in many forms of government assistance, including: o veteran's medical and home care benefits o housing assistance o housing loans for veterans o child's education loans o educational loan repayment schedule o agricultural price supports and loans o eligibility for federal matching campaign funds * Ineligible for National Affordable Housing program if spouse ever purchased a home: * Subject to conflict-of-interest rules for many government and government-related jobs * Ineligible to receive various survivor benefits upon remarriage Ambiguous There are some laws that either benefit or penalize married couples over single people, depending upon their own circumstances: * Marriage penalty/bonus * Someone working for their spouse cannot be defined as an "employee" * Someone cannot change beneficiaries in a retirement plan or from waiving the joint and survivor annuity form of retirement benefit, without the written consent of his or her spouse * Wages can be garnished at a maximum of 60% (instead of the normal 25% limit) if the garnishing is for alimony or child support States In addition, community-property states frequently have forms of ownership that allow a full basis step-up on one's own share of community property on the death of a spouse (in addition to the normal step-up on spouse's assets). Legal remedies enacted following the GAO report Following this report, at least one bill went through Congress to attempt to remedy some of the differences in rights between same-sex partnerships and marriages.
