I'm really not supposed to drive on my suspended license, but nobody can afford an uber every time so sometimes I still do. When I do I'm scared of getting caught. I see cops and get nervous.
My problem is I have habitual offender status and have been cited or charged with operating while suspended 4 times (once was a ticket and 3 were with arrests). My 4th was charged as driving suspended after habitual offender status. The reason I'm nervous is that if I got a second one of those it would be charged like this:
"B. A person is guilty of a Class C crime if the person violates subsection 1 (operating after suspension for habitual offender) and:
(1) The person has one conviction for operating after revocation under this section or under former Title 29, section 2298 within the previous 10 years;
OR
(2) The person has one OUI conviction within the previous 10 years.
The minimum fine for a Class C crime under this paragraph is $1,000 and the minimum term of imprisonment is 6 months, neither of which may be suspended by the court. "
I fit bullet one since I've operated suspended after being a habitual offender once, so I would meet the requirements for the minimum which is 6 months of imprisonment.
I'm scared of going to jail for that long. Every time I see a cop I know that if he pulls me over I will be in big trouble. As I'm leaning against my car getting handcuffed I will be knowing I will have to be imprisoned for at least 6 months (and that's minimum).
If you think I've learned my lesson, know that at least once a week I commit a crime that would jail me for a MINIMUM of 6 months.
When I arrested for the third time the cops came to my apartment to execute a warrant.
I had just been chilling in my apartment when I heard the knock on my door, and 5 minutes later I was being frisked and patted down against the wall of my living room. A cop took a pair of handcuffs from his belt and locked them tightly on my wrists while he told me "Lucas I'm placing you under arrest".
Another 5 minutes and I was being lowered into a cop car outside while my neighbors watched. I wasn't sure if I was going to the local police station. It was still afternoon so I was wondering if I could be bailed out later that day, but as the cop put my seatbelt on he told me "You're going to the Androscoggin County jail, and you may be able to be bailed out tomorrow". Now I knew I had a 40 minute ride in and that I was going to be locked up over night.
