What Has Changed for 1099-NEC and 1099-MISC Both?
The new 1099-NEC form, which includes Copies A, B, C, 1 and 2, can be completed online unlike the one used before 1982. The deadline for all independent contractors to file Form 1099-NEC is January 31.
The 1099-MISC form is still used to record things like rent, lawyer fees, royalties, awards, prizes, interest, and medical expenses, among other things that are specified. Additionally, it has two different filing dates: March 1 for paper filing and March 31 for electronic filing.

For reporting under section 6050R relating cash payments for the acquisition of fish for resale purposes, Box 1 will not be utilized.
Any sales of consumer goods for resale, whether on a buy-sell, deposit-commission, or other basis, totaling $5,000 or more, may be reported by payers using either box 2 on Form 1099-NEC or box 7 on Form 1099-MISC. The form has been scaled back (reduced the height).
Miscellaneous Information has replaced Miscellaneous Income as the title for Form 1099-MISC.
Any information required to be reported under section 6050R relating cash payments for the acquisition of fish for resale from an individual or company involved in fish catching is included in box 11. See the box 11 instructions for more information.
The 1099-MISC no longer allows the reporting of nonemployee compensation for some services, unlike the 1099-NEC. A 1099-MISC reflecting the payment of principal, interest, and any associated fees subsidized by the Administrator under section 1112(c) of the CARES Act is no longer required for lenders to file with the IRS or to provide to borrowers as of 2021, according to the Internal Revenue Service.
How Does Your Business Affect the 1099-NEC and 1099-MISC Forms?
You could be unsure of which form—1099-MISC or 1099-NEC—should be utilized. You can be required to use a 1099-NEC, 1099-MISC, or both, depending on the requirements of your firm throughout the tax year. In order to fill a specific need or role within their organization without having to fill a full-time position, many businesses now use independent contractors.
There are several places where you can find freelancers and independent contractors, including job boards, social media, and business networking sites and associations. For instance, if your business requires a website, it might engage a web developer or a company to assist in creating a corporate website.
In this situation, you must complete a Form 1099-NEC if the web developer is paid more than $600.
A Form 1099-MISC must be completed when paying rent, distributing royalties, or engaging the services of a lawyer, to name a few instances. (Visit the IRS website for a complete list of situations needing a 1099-MISC.
A 1099-MISC and 1099-NEC Filing Guide Form
The employer must submit Forms 1099-NEC and 1099-MISC to the IRS for filing. You must deliver a copy of Form 1099-NEC to the contractor by January 31 in addition to filing it with the IRS by that date.
You will be held responsible and required to pay a fine if the IRS filing deadline is missed. The fine is $50 if you file within 30 days of the due date. The penalty doubles to $100 if you are more than 30 days overdue. If you pay after August 1 the fine will be $260. Using Form 8809, you can request an extension if you have trouble submitting the 1099-NEC on time.
To file a 1099-NEC, you will need the following:
Information about your business: Included are the name, address, and Employer Identification Number of your business (EIN)
Information about the independent contractor: Including the person's name, address, and Social Security number or EIN
Compensation Amount: Box 1 should be increased by the total compensation paid for the prior tax year.
Boxes 4–7 of the form are for federal or state income tax withholding information.
In order to file a 1099-MISC, you will need:
Information about your business: similar to the Form 1099-NEC's preceding list of comparisons. Include the name, address, and EIN of the business.
Information about the independent contractor: Including the person's name, address, and Social Security number or EIN
Cost of the award: The entire amount paid for nonemployee remuneration during the preceding tax year, including rent, payments for healthcare and medical expenses, dividend or interest replacement payments, etc.
Omitting certain details Federal income tax withholding is indicated in Box 4 of the form.
Both filings are, for the most part, simple to complete and understand. An Annual Summary and Transmittal Form 1096 is also a part of the procedure, and it needs to be submitted to the IRS with your submission.
