When an AI acts on a person’s behalf, is that AI operating as an extension of the user’s will? Or is it operating on behalf of the company that made it? On its own behalf? On nobody’s behalf?
The answers to this question will determine much about how AI is treated in the legal system... (Some) have developed complex proposals about how AI acting on a user’s behalf should be treated legally. The problem with those proposals is that it is impossible to contemplate ex ante all of the potential complications that might arise in the real world... (An alternative is) agency law, updated iteratively to reflect the unique characteristics of AI (namely, that it does human-like things while not possessing legal personhood), adjudicated within a new kind of legal or arbitration venue designed specifically for this purpose.
