AVERY- “YOU ARE CRAZY!!”

ETTA- “Can you explain the surveillance footage that we were able to obtain from the Hotel Marquee of you leaving the room where Fallon and Max Villareal were murdered, just a few minutes AFTER they were supposedly killed? Or the surveillance of you and your wife assisting Noah Boedell into a cab, and you returning alone to the murder scene but not coming back out...at least not in your clothing.  We enhanced the video of what the police thought was Noah Boedell walking down 24 flights of stairs, and come to find out, it was you Mr. Wilson, dressed in Mr. Boedell’s clothing.”

AVERY- “What a nut case...you call yourself an attorney?  You can ask my wife any of this...”

ETTA- “Oh, we have and she is willing to testify that she assisted you putting Mr.Boedell in a cab and asking her to see that he made it to his private plane and fly with him back to Oasis Springs to make sure he made it home safe.  Unknown to her were the two murdered people in the room next to your room, that YOU murdered, until SHE heard the news reports and you told her you were trying to help Noah escape arrest because you knew he was drugged by Fallon and shouldn’t have to go to jail.  Did you think your wife believed you? You knew he would be drugged and out of it, a perfect way to take care of your problem.”

AVERY- “Actually, yes, my current wife and I were on a second honeymoon. I had no idea that the Boedell’s were there until I heard the news the morning following the murders.”

ETTA- “And where were you when you heard of the murders?”

AVERY- “We were at the airport. It was all over the news.”

ETTA- “And where did you get the funds to pay for your trip abroad?”

AVERY- “I am not sure what you mean, it came from our savings account.”

ETTA- “Which were deposited into your savings account three days prior, along with $10,000.00, isn’t that correct, Mr. Avery?”

AVERY- “I don’t know what you are talking about?”

ETTA- “Isn’t it true Mr. Avery that Fallon Bachelor Boedell paid for your trip to Parisims, because you were blackmailing her regarding her involvement in the DiSalvo case?”

AVERY- “NO!!  Are you mad?  I would never do that.  I am a former police officer mam.”

ETTA- “Can you tell us which hotel you were staying at while you and your current wife were having your second honeymoon?”

AVERY- “The Hotel Marquee, but I don’t undert...”

ETTA - Isn’t it also true that you were in the room directly next to the Boedell’s room, and there was an adjoining door between the two rooms?”

AVERY- “I was in their room the whole time.  I laced their drinks, and waited for them to fall asleep. He drank his glass of wine, but she didn’t. Once they both fell asleep I went over to the bed and was going to take him out, but just as I did she woke up ….

                Fallon- “Avery!!?? What the hell are you???

AVERY- “And I shot her, once, right in the head. then three more times, to make it look like a crime of passion. Once that happened, then Villareal, who thought I had shot Boedell came running in. He saw Fallon dead, and thought Noah was as well, but Noah was still out from the drugs. 

“ I had no choice at that point, I killed him as well. That’s when I knew I had to keep Noah alive and he would take the fall for the murders, so I picked him up off the bed and took him in the shower and woke him up.  He was still groggy as hell and had no idea what had happened. That’s when I woke up my wife…who I also had given a sedative to and had her help get Noah in the cab and to the plane. I went back up the back stairwell and changed into Boedell’s clothes and left in a cab. It worked too!!  It would have continued to work if Boedell wouldn’t have came out of hiding.  I have been drugging him and keeping him in the bunker for five years.  I knew i should have killed him down there in that hell hole!!!”

AVERY - “My name is Avery Wilson, Sr., and I was married to Fallon Bachelor, prior to Noah Boedell.  As for Max Villareal, I had no relationship with him, other than knowing he was a director and friend of my ex wife.

ETTA- “You and the deceased, Fallon Bachelor have a son together, isn’t that correct?”

AVERY- “Yes, we had a son together, Avery Jr., he is a student at Oasis High School. He is a senior this year.”

ETTA- “You also were at one time the Chief of Police in Oasis Springs, correct?”

AVERY - “Yes, I was on the force for six years, the last 8 months I served as Chief of Police.”

ETTA- “You have full custody of your son, isn’t that correct Mr. Wilson?”

AVERY- “Yes, since he was about five years old.”

ETTA - “Can you explain how you received court ordered custody of your son?”

AVERY- “The court granted custody on the grounds of her being an unfit mother, and administering un-prescribed medication to him.  She had been drugging him with ADHD medication.”

ETTA- “Did Avery Jr. have ADHD?”

AVERY- “No he did not. Hence the main reason I receive full custody and she had supervised visitation, which she no longer met after she and Mr. Boedell married.”

ETTA- “Okay, let’s go back to when you were married to Mrs. Boedell.  How was your marriage relationship?”

AVERY - It started out very normal. I was working the case regarding the death of her mother and we became close. We married during that time.”

ETTA- “You are speaking of the Marlana DiSalvo case several years back, where Marlana DiSalvo killled Karen Caparini, and later her husband and several others correct?”

AVERY- Yes, that is correct. Karen Caparini was Fallon’s mother.”

ETTA- “So in the beginning things were good, what caused the divorce?”

AVERY- “As I said, when we met I was working the DiSalvo case and I found out after I was dismissed from the case, and let go from the department that Fallon actually knew Marlana DiSalvo prior to her mother’s murder.  They met in Europesims. The reason for my firing was the department thought I was leaking information somehow to DiSalvo for her to continue to escape custody.  All the while it was Fallon that was giving her this information.”

ETTA- “So why didn’t you turn her in at that time?”

AVERY- “She denied it and I didn’t have enough evidence to prove it, as the person that gave me that information was also murdered.  No one even connected their death to the DiSalvo case, but I always assumed it was DiSalvo, or Fallon.”

ETTA- “So unknown to you, Fallon was leaking information to DiSalvo to enable her to escape from custody.  You found out about this at a later time and did you tell your wife of this infromation you obtained?”

AVERY- “Yes, she denied all of it. We began to fight constantly, and that is when I left and filed for divorce.”

ETTA- “But you recently came into some information regarding this matter and you were planning to turn Fallon in correct, and save your name with the department?”

AVERY- “Yes, but she was killed before I could do that.”

ETTA- “Would you elaborate on this information and where it came from?”

JUDGE BAILEY - “Miss Wahl, the prosecution has no further witnesses.  You may call your first witness.”

ETTA- “I call my first and ONLY witness.  Avery Wilson, Sr.”

JUDGE BAILEY - “As you take the stand Mr. Wilson, may I remind you of the oath you have taken prior to this hearing.”

AVERY- “Yes, your honor.”

JUDGE BAILEY- “Miss Wahl you may proceed with your questioning.”

ETTA- “As you know we have asked you here today to testify in regards to the history and background of Fallon Bachelor Boedell.  This is to determine her criminal past, as you know it. For the record, can you please state your name and your relationship with the victims, Fallon Bachelor Boedell and Max Villareal?”

AVERY- “About two weeks before she was killed, Fallon called me out of the blue.  I had not spoke to her since before she and Noah Boedell married. She said she was coming into a lot of money and wanted to take Avery Jr. on a trip. Of course, he had no desire to do anything with his mother and I told her so. She became angry and proceeded to tell me how she had played me all those years before. She said it was her plan to kill her mother and Anthony Caparini and get all of the Caparini money. She said she hired DiSalvo to kill them, but when she decided to back out of her end of the bargain that was when DiSalvo started killing all the Capirini family members.

ETTA- “So you are saying fallon admitted to all of this two weeks prior to her death, and you were unaware of all of it until then.”

AVERY- “I knew she was involved, but had no idea to what extent.”

ETTA- “So did you tell Ms. Boedell that you were going to turn her in?”

AVERY- “She said she didn’t care, she was going out of the country and no one would ever find her.  And she would have all the Boedell money to help her live comfortably the rest of her life.”

ETTA- “Did she tell you how she was going to come into all the Boedell money, or say anything about drugging Noah Boedell?”

AVERY- “No, she never mentioned any of that. I assumed just because they were married she had his money.”

ETTA- “Very well, thank you Mr. Avery.”

AVERY- “So I may step down?”

ETTA- “Actually, I have one more question.  Were you in Parisims during the time of your Ex-Wife’s death?”
