Artist Accuses MullenLowe of Using His Works Which Was Copied on a Stock Service to Win a Cannes Lion
The Cannes Lions Festival has recently come to an end and as the industry is trying to recover, an artist has accused MullenLowe of using his work to win a Cannes Lions. The artist’s name is Rik Oostenbroek, he is a freelance illustrator. He is accusing agency MullenLowe SSP3 in Colombia of using stock imagery that copies his signature style and dropping it into a Hyundai campaign that features little more than the stock art.
Rik Oostenbroek Accuses MullenLowe of Using His Works Which Was Copied on a Stock Service to Win a Cannes Lion
The Hyundai campaign that Oostenbroek is calling out MullenLowe who recently won a bronze Lion in the Cannes Lions Print & Publishing category this year. It also won a Wood Pencil at the D&AD Awards last month. According to Oostenbroek, the work features imagery that, similar to the style he has been known for. When he spoke to Adweek about it, he stated that clients hire him for that particular imagery and that is how people identify him. The imagery conveys motion through swirling, colourful shapes. According to the artist, when he first noticed the work on creative platform Behance, he left a comment about the similarity to his work. He claims that he received a response within hours from Carlos Andrés Rodríguez, CCO of MullenLowe SSP3. According to Osstenbroek, Rodriguez apologized and told him that the agency did not intend to steal his work. He also let the artist know that they legally purchased the rights for the illustrations through Shutterstock.
Oostenbroek Speaks
According to the artist, he was going to let it go until he saw that the work was winning industry awards. He told Adweek that he was shocked and mind blown by the awards the work was winning, especially since its only awards an individual like him can only dream of winning. Oostenbroek said “The agency apparently is still super proud of a campaign they only put copy over. The judges don’t do any research on what the original source is in this case.” He stated that he was surprised to see such a respected agency like MullenLowe being super proud of a campaign built around stock images. Oostenbroek said, “Where is the line in this case?”Why does this get rewarded by institutions who are supposed to pick up good work?”
Cannes Jury Member Speaks
A member of this year’s Print & Publishing jury, which gave the Hyundai campaign a bronze spoke about the issue. He shares the artist sentiments, stating that building a campaign from a stock collection is very lazy. The Juror stated that if they had known, they would have altered the rating of the piece. The Juror was also dismayed that the work resembled the artist work very closely and that he was not credited or remunerated.
MullenLowe Responds
Here is how the agency responded when asked to make a statement by Adweek: “We’ve recently been made aware of some discussion around one of our campaigns. We understand the concerns that have been raised and have always been committed to supporting the creative rights of any author. As a company, we follow strict protocol put in place by our external auditors which ensures that we do not air any campaign for which we do not own the rights. “In regards to this particular campaign, the images were identified as the most fitting way to illustrate the important ‘don’t text and drive’ message for our client. The appropriate rights for the four images were purchased through the correct channels and we acted legally within the terms of the licence. We have been in contact with the artist claiming credit for the work on social media, with a full explanation of the creative process and the surrounding legalities.
