Central Tribunal Dismisses Ex-IT Commissioner's Plea Over 'Pre-Mature' Retirement
New Delhi: The principal bench of the Central Administrative Tribunal (CAT) has dismissed the plea of Pramod Kumar Bajaj, former Commissioner of Income Tax (CIT), who had complained against his compulsory retirement ordered under Fundamental Rule 56(J). Fundamental Rule 56 (J) allows the government or any other valid authority to order pre-mature retirement of any government employee after he/she has completed 30 years of service. The premature retirement of government servants under these rules is not a penalty. Bajaj is one of the 85 officers who were ordered by the Centre to compulsorily retire from the Income Tax Department last year. The principal bench of CAT headed by Justice L. Narasimha Reddy said, "We do not find any merit in the OA (Original Application) and the same is accordingly dismissed." Agreeing to the government's decision it further said that it was no longer in the interest of the department to continue the applicant in service, as "the personal life of the applicant was not only extraordinary but also dented the very reputation of the department. When such is the status, which the applicant has acquired for himself, the respondents (the government and the CBDT) are left with no other alternative except to invoke Rule 56 (j)."
