No suggestion to make caning a crime in new Child Act
KUALA LUMPUR, March 16, 2015:
The Women, Family and Community Development Ministry does not intend to create specific provisions in the new Child Act Bill to state that the caning of children would be a crime.
Deputy Minister Datuk Azizah Mohd Dun said in Parliament today the caning offence that could cause physical or mental injury to a child was already provided for in existing laws, namely under Section 31(1) of the Child Act 2001, and it would be maintained.
“The provision will be maintained and the ministry is currently analysing and fine-tuning suggestions to include a prison sentence or increase the fine, including suggestions to cane anyone who commits the offence under Section 31(1) of the Child Act.
“These were measures to ensure the protection of a child’s interest, by balancing between the rights of children and parents, guardians in education and the discipline of children in a positive way.”
She said this in reply to Sipitang-BN Member of Parliament Datuk Sapawi Ahmad Wasali who asked the ministry to state the feedback received from the public on the suggestion to make the caning of children a criminal offence in the new act, which would replace the existing Child Act.
The new act, previously announced by Minister Datuk Seri Rohani Abdul Karim, would be tabled in Parliament by June and would include, among others, punishment against parents who caned their children.
According to Rohani, the government had no choice but to make caning an offence because Malaysia was among the countries that signed the Convention on the Rights of Children (CRC).
Azizah said that the ministry also suggested to drop the punishment of caning children who had committed a criminal offence.
“Caning provisions will be dropped to increase a child’s spirit. The punishment is an act that will give a negative impact on a child’s emotions.
“Caning will cause prolonged trauma and children will not be able to function rationally.”
