Kerry Kennedy, daughter of the late Robert F. Kennedy, is currently on trial in Westchester County, New York on charges of driving under the influence in a July 2012 highway accident. Could Kennedy be another case of Ambien ‘zombie-ism’? That’s up to a jury right now.
Kennedy claimed to have no memory of the trip on Interstate 684 when she swerved into a tractor-trailer truck. She does not, however, deny that she was at the wheel. Kennedy claims the accident was the result of her accidentally taking Zolpidem (the generic equivalent of the sleeping medication Ambien) that morning instead of her usual thyroid medication. According to her testimony, she had no trouble driving the car to the highway. After she got on the highway, however, she testified that she didn’t remember anything until an officer woke her after the accident. On Tuesday, a toxicology expert testified that the drug could, in fact, have rendered Kennedy incapable of realizing that her driving was impaired. Toxicology reports showed the presence of a small amount of Zolpidem in Kennedy’s system at the time of the crash.
The prosecution contends that Kennedy should have been aware of the encroaching drowsiness being brought on by the medication. And that should have been enough for her to pull over and get off of the road. However, Elizabeth Spratt, director of toxicology for the Westchester County Department of Laboratories and Research, testified that it usually takes anywhere from 15 minutes to a half-hour for the medication to reach the brain, and it begins to lose its efficacy after about two hours. She also testified that both amnesia and “sleep driving” were both established side effects of the medication.
The case is now in the hands of the jury. If the prosecution is able to convince them that Kennedy drove in full knowledge that she’d taken the Zolpidem and not her thyroid medication, Kennedy could face a year in jail.
