Four Minneapolis-based Tax Return Preparers Indicted

Minneapolis tax preparers Chatonda Khofi, Ishmael Kosh, Amadou Sangaray and Francis Saygbay have been indicted on 63 counts regarding a conspiracy to defraud the Internal Revenue Service. All four named defendants allegedly prepared false tax returns under the name of Primetime.

Primetime Tax Services Inc. was a tax return preparation business with three storefronts in the Minneapolis area.  Khofi worked as the Chief Executive Officer of Primetime, and Kosh and Sangaray worked as managers of the Brooklyn Center location of Primetime. 

According to court documents, Khofi, Kosh, Sangaray and Saygbay conspired amongst themselves and with others to prepare and file false individual income tax returns for the customers of Primetime.  Some of these returns reported false dependents, false deductions, false Schedule C business losses and false wage income. These false entries resulted in fraudulently inflated refunds for their customers. 

As part of the scheme, court documents allege that the defendants prepared and filed false Minnesota state income tax returns for their customers that contained the same or similar false information as reported on the federal income tax returns.  From 2007 to 2009, Primetime filed over 2,000 customer federal income tax returns with the IRS.

The indictment further charges each defendant with multiple counts of aggravated identity theft and multiple counts of aiding and assisting in the preparation of false individual income tax returns.  The aggravated identity theft charges stem from the defendants’ alleged use of the names and social security numbers of actual persons to falsely claim as dependents on their customers’ individual income tax returns.

According to the indictment, the defendants also accompanied some customers to check-cashing businesses to cash their falsely inflated tax refund checks, then demanded a portion of the cashed refund check in addition to tax preparation fees already collected. 

If convicted, the defendants face a maximum potential sentence of five years in prison for the conspiracy count and three years in prison for each count of aiding in the preparation of a false tax return. The aggravated identity theft counts have a mandatory two year sentence. 

In announcing the charges, the Justice Department noted that an indictment is merely an allegation and all defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

Daniel Lynch, a former sales executive of Siemens Building Technologies and current president of Treadstone Development Corporation, has been indicted in New Jersey for stealing $75,000 from Siemens and the Upstate Telecommunications Corporation (UTC).

UTC is a not-for-profit organization that contracts with Monroe County to provide upgrades to the County’s information technology and copier systems.

According to the Attorney General's indictment, Lynch, 50, of Rochester, caused Toshiba Business Solutions to create and submit false invoices to Siemens to pay for a portion of a tent at the 2008 Senior PGA Championship tournament held at the Oak Hill Country Club.

The indictment alleges that Siemens’ corporate policies prevented Lynch from using company funds to pay for the tent. The false invoices submitted to Siemens by Toshiba Business Solutions indicated that a contractual relationship existed between Siemens and Toshiba for the design, development, and management of a UTC copier project, when in fact Toshiba had already contracted directly with UTC for those services.

The false invoices submitted to Siemens totaled $75,000, which Siemens paid to Toshiba. Toshiba then used the $75,000 to purchase the Senior PGA Championship tent. The indictment further alleges that Lynch caused false entries to be made in the business records of UTC and Siemens to conceal the theft. 

Lynch is charged with Grand Larceny in the Second Degree, a class C felony, and two counts of Falsifying of Business Records in the First Degree, a class E felony. The maximum prison sentence for Grand Larceny in the Second Degree is five to 15 years in state prison. 

Lynch was arraigned before the Honorable Robert Noonan, Acting Supreme Court Justice of Monroe County. He was released on his own recognizance.

Former Loan Officer Gets 36 Months for Stealing from Credit Union

Erin Dawn Trevathan, 26, of Amarillo, Texas, has been sentenced by U.S. District Judge Mary Lou Robinson for fraud in connection with federal credit union entries.

According to documents filed in the case, Trevathan was employed by the Pampa Teachers Federal Credit Union as a loan officer from July 2008 until early December 2010, and during that time, she was the sole loan officer at the credit union. Her job consisted of processing personal loans and auto loans.

During an audit, irregularities were noticed. When confronted, Trevathan admitted that she had been making false entries and stealing cash from the credit union’s main account for her personal use.

As a result of her false entries, loan manipulations, and unauthorized activity, the Pampa Teachers Federal Credit Union suffered a loss of approximately $422,973.

Judge Robinson sentenced Trevathan to 36 months in federal prison and ordered to pay $442,297 in restitution following her guilty plea April 2013 to one count of fraud. She was remanded to custody.

The case was investigated by the FBI, with assistance from the National Credit Union Administration. Assistant U.S. Attorney Christy Drake was in charge of the prosecution.

According to court documents and statements made in court, Turey served as the controller for a market research company located in Stamford. As controller, Turey’s responsibilities included aggregating the company’s monthly revenue and expense results, managing the company’s accounts receivable, performing financial analysis and reporting, and overseeing the company’s bookkeeper. Turey also was responsible for the company’s general ledger and was in charge of conducting the company’s bank reconciliations.

Between August 2005 and January 2013, Turey embezzled approximately $3,462,435 from the company by writing checks to himself or to a fictitious entity for his personal benefit and depositing those funds into bank accounts he controlled. Turey made numerous false entries in the company’s books and records to conceal this scheme.

The majority of the embezzled funds were subsequently transferred into Turey’s online brokerage account.

Turey is scheduled to be sentenced by United States District Judge Janet C. Hall in New Haven on August 20, 2013, at which time Turey faces a maximum term of imprisonment of 20 years.

Turey has been free on a $300,000 bond since his arrest on February 14, 2013.
