After Laughter Vinyl Issues
Purpose: to inform Paramore fans that received the wrong copies of the After Laughter vinyl on what their rights as customers are under United States consumer laws and FBR store terms of use.
If you're reading this, I hope that you’re not one of the people that got screwed over in this Paramore Webstore mix up where some customers have received the wrong copies/colors of their vinyl orders.
If you know someone who has been affected by this, please link them this post as a way of informing them what their rights are.
Back story: I am one of the affected customers. I ordered one copy of After Laughter in teal, and one copy in pink, and I received two teal copies. I have contacted the Paramore Webstore on the issue, and haven’t heard back, as it is the weekend, and they probably won't reply till Monday.
Paramore’s Webstore return policy states: “Please note: exchanges for limited edition items (such as colored vinyl, signed items, numbered editions, etc.) are subject to available inventory at the time of the receipt of the exchange. If your item is a CD or vinyl release, it must not be opened and remain sealed in its plastic wrapping to qualify for a refund or exchange. If we no longer have these limited items in stock you will be automatically given a refund.”
If you received more vinyl than you were supposed to, ex. you ordered one pink or one teal, and received two of either:
“What do you do when you receive merchandise that you didn’t order? According to the Federal Trade Commission, you don’t have to pay for it. Federal laws prohibit mailing unordered merchandise to consumers and then demanding payment.”
“Q. Am I obligated to return or pay for merchandise I never ordered? A. No. If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift.”
The prior quotes are from HERE.
If you received two copies of one color when you ordered both colors:
“11. Product Delivery. [...] Except to the extent that applicable law provides otherwise, your sole and exclusive remedy with respect to any Product that is not delivered within a reasonable period will be either replacement of such Product or a refund of the purchase price paid for such Product, as determined by us in our sole discretion.”
The prior quote is from FBR’s Term’s of Use found HERE.
What this means, is everyone needs to contact the Paramore Webstore/FBR Webstore and explain each particular situation/problem to receive either a refund or replacement (probably not gonna happen) of the color that they did not receive. Do not send it back.
These are your rights legally.
