The Legal Requirement On Business Owners To Undertake Fire Risk Assessments

The Regulatory Reform (Fire Safety) Order 2005 (FSO) replaces previous fire safety legislation and places a duty on the Responsible Person to carry out and review a fire risk assessment.

The definition of "Responsible Person" is as follows:

In relation to a workplace, the employer, if the workplace is to any extent under his control. In relation to any other premises it is the person who has control of the premises (as occupier or otherwise) in connection with the carrying on by him/her of a trade, business or other undertaking (for profit or not)

Or

The owner, where the person in control of the premises does not have control in connection with the carrying on by that person of a trade, business or other undertaking.

Your Duties As An Employer With Regard To Fire Risk

When you operate any sort of business you have a duty to ensure the safety of your employees or customers with regard to any type of fire risk. The Regulatory Reform (Fire Safety) Order 2005 (FSO) replaces previous fire safety legislation and places a duty on the responsible person to carry out and review a fire risk assessment. For all practical purposes, if you own or manage the business you are the responsible person. Although there may be situations where the building owner is responsible if you rent it. It is safest to assume that if you own or manage the business it is you who is the responsible person.

It follows that you need to undertake a fire assessment so that you know the possible risks of fire occurring and have in place all of the necessary things to (a) prevent a fire from occurring and (b) have in place systems and equipment to deal with it if a fire should break out. For example, these would include fire-fighting equipment, escape routes, and so on.
