Huan cries foul over speedy gazetting of by-election results

GEORGE TOWN, July 2:

More than a month after losing in the Bukit Gelugor by election, Parti Cinta Malaysia vice-president Huan Cheng Guan has expressed shock over what he described as “super efficiency” of the Election Commission (EC) in gazetting the Bukit Gelugor by-election results within days of the polling day (May 25).

He claimed that there was “something fishy” about the efficient speed of gazetting the result.

He suggested that it could be a deliberate act to prevent him from filing an election petition to expose DAP’s wrongdoings during its campaign.

Bukit Gelugor by-election results were gazetted on May 28, three days from the polling day on Sunday May 25.

Huan, who contested and lost in the by-election, said normally the EC would take a month or so to gazette an election result, after which a candidate can file an election petition within a 21-day time frame from date of gazette.

He revealed that a check with an EC top official last week confirmed the result had not been gazetted yet, but a check on the attorney-general’s website at the same time led to a discovery that the by-election results had been gazetted on May 28.

“The EC had gazetted the results within two working days. It’s a record for the EC.

“I’m shocked at  the EC’s super efficiency,” said Huan at a press conference here today, pointing out that May 27 (Tuesday) was a public holiday for Israk Mikraj celebration.

He said perhaps the EC should consider amending the current election rule to fix a certain time period from polling day, not the date of gazette, for contestants to file election petitions.

He said this would avoid the confusion arising from “efficiency” of the EC in gazetting the election results according to its own time.

DAP’s Ramkarpal Singh Deo won the Bukit Gelugor by-election by a majority of 37,659 votes.

Ramkarpal, 38, polled 41,242 votes while Huan, 53, polled 3,583 votes and lost his election deposit.

Independent candidates Nabi Bux Mohamed Nabi Abd Sathar, 63, received 799 votes and lawyer Abu Backer Sidek Mohamad Zan, 46, garnered 225 in the four-cornered battle.

Spoilt votes were 539.

Huan claims that he had prepared everything necessary to facilitate his election petition, such as photographic evidence and witnesses.

He expressed disappointment, saying he had lost the chance to expose the DAP’s breach of election rules.

“I demand the EC give an explanation and carry thorough investigation on this so speedy gazette,” he told a press conference earlier today.
