In this recently-filed complaint, GoVino claims trade dress rights in the notched design shown in this design patent. It has accused GoVerre (shown below) of trade dress infringement because its competing products feature a (non-indented) oval. Worse, it claims that its design patents prove that the claimed indent design is ornamental (no, they don’t).
Side note: The drawings in Figs. 4-8 of the patent shown above look like utility patent drawings. If I were litigating this case, I’d check to see if there are any TrafFix arguments.
