California Phone Searches: Your Rights
In California, cell phone contents are protected under Riley v. California and the 4th Amendment. If you're asked to unlock or hand over your device, here's what to do:
Do NOT Consent: This is the most critical step. Calmly but clearly state, "I do not consent to any search of my phone."
Ask for a Warrant
Remain Silent & Get Counsel: If police search your phone anyway, remain silent and immediately seek legal advice. The legality of the search can be challenged later in court.
