Victims of abuse in California school silenced by their immigration status

Eight families affected by child abuse at an Elementary school in California say they were afraid to come forward because they are undocumented immigrants, according to the Spanish-language daily, La Opinion.
Members of the families say their children are former students of Mark Berndt, a 61-year-old second grade teacher at Miramonte Elementary School charged with 23 counts of committing lewd acts on children after he allegedly fed spoonfuls of his semen to his students. They say they did not know who to turn to when their children told them they were victims.
La Opinion reports that one parent, Raymundo, experienced heart problems that landed him in the emergency room after his daughter told him what had happened.
"One encounters many emotions," Raymundo, who asked to withhold his last name to protect the identity of his daughters, said in Spanish. "Helplessness, rage, fear of not having papers. All that affected me at that moment."
Jorge-Mario Cabrera, a spokesman for the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA), explained that the families had refrained from reporting the cases to the Sheriff's department in Los Angeles out of fear that they would be flagged down by Secure Communities.
Under Secure Communities, local law enforcement agencies can check the fingerprints of anyone in their databases against FBI records. The results are shared with immigration officials, who can then decide to detain or deport the person in question if he or she has a record of immigration violations.
Opponents say the program creates a rift between local police and the communities they are meant to protect.
"The sheriff doesn't understand that the collaboration they have with immigration authorities through Secure Communities sows a culture of fear among the undocumented population," Cabrera told La Opinion. "People are afraid to talk. They are afraid to approach the police and report crimes because they don't want to be deported."
The families have found legal representation and filed civil lawsuits in the Los Angeles Superior Court. They are scheduled to present evidence against Berndt on Thursday.
The sheriff's department says they have been working to identify victims using photographs obtained during a police investigation, and contacting the families of those identified.
Lieutenant Carlos Marquez told La Opinion that none of the parents they contacted had said they were afraid to talk, but that some people in the community had expressed concern that others might not want to come forward because of their immigration status. He said members of the department had repeatedly said at community meetings that people should not worry about their immigration status.
Marquez also said that it is likely that some victims have not yet been identified. On Wednesday, the department said it found 200 more of Berndt's pictures to add to 390 already in their possession.
Angelica Salas, executive director at CHIRLA, has called on Los Angeles County Sheriff Leroy Baca to offer a written guarantee that his department will not take action against the parents or children who seek support and may also be undocumented immigrants.
"The Sheriff’s enthusiastic support of the so-called 'Secure Communities' program is troubling and may hinder progress in this investigation unless he goes to extreme measures to inform the community they have nothing to fear," Salas said in a statement.
