What is a mechanic's lien? It is probably not what you think.
Contrary to the conceptual idea from the name, it is not for car repairs. A mechanic's lien is a lien against real estate.
Virginia statute § 43-3, entitled "Lien for work done and materials furnished; waiver of right to file or enforce lien" provides A. All persons performing labor or furnishing materials of the value of $150 or more, including the reasonable rental or use value of equipment, for the construction, removal, repair or improvement of any building or structure ...shall have a lien...upon such building or structure, and so much land therewith as shall be necessary for the convenient use and enjoyment thereof, ....for the work done and materials furnished.
This means if a person or company - usually a contractor - performs work on a building or real estate, they have an option to obtain a lien for payment.
