I'm pretty sure that paypal thing is just fear mongering. I can't find it right now, since the reply is drowned out by people being fed this misinformation, but someone who actually know how things work said the fine only counts for actual illegal activities. Real crime, not just avoiding a tiny fee with the gift option.
Seems like pretty harmless advice to me regardless.
