Note: I have no definite idea about the legal side of this post so please correct me if I'm wrong!!
I've been seeing this "India grants freedom of sexuality as a fundamental right" headline going around for WEEKS and im-
The fact that this law was passed is FUCKING GREAT. We were celebrating it the day it happened. But in direct opposition of this law sits the fucking article sec-377, a law still in use from the FUCKING BRITISH ERA, which literally classifies homosexual sex as unnatural and punishable to a life sentence.
YES. India, the largest democracy in the world, is still using an archaic, idiotic law passed by the Britishers when they colonised the country.
In fact I remember reading that Sec-377 used to include a beastality clause too? I'm not sure but yeah gay sex was included with a clause condemning sex with animals.
While the fundamental right overrules everything which stands in direct opposition to it, and while I believe that the Supreme Court is probably going to judge in favour of the pending case for scraping the inhuman and disgusting Sec-377, I STILL find it Difficult to imagine India, accepting and embracing queer people with even a 51% majority.
We can't watch a gay kiss on screen!!! Why???? BECAUSE IT WILL GET CENSORED. The movie will probably be boycotted???? I don't know, people here are fucking assholes who have zero education.
Go to any Bollywood celebrity's Twitter, if any of the Decent or Socially Aware celebs try to talk about homosexuality, the fans and haters wreak havoc and make the reply section a breeding ground for homophobic comments.
And GOD FORBID!!!! If a phony religious figure talks shit about something he doesn't know i.e. homosexuality and then if a celebrity addresses the topic on social media with the correct facts, then you are as good as dead!!
The SC should hurry the fuck up, scrap sec-377, introduce a fuck load of laws to support the fundamental right of freedom of sexuality. While the SC has passed very helpful laws for transgender people and their empowerment this year, the country is still lacking in being aware and considerate of queer people.
As a side note, Hindu mythology and culture literally had queer and transgender people ALL THE TIME. We have temples with figures of lesbian Gods having sex like!!!!! Our culture was very inclusive. I have no idea what the consensus was just before colonisation but I'm sure it would've been nothing close to the "beast sex and gay sex are the same thing" ideology.
While the queer web series by many, many lgbt+ people online is sure helping the situation, I do need to watch two girls or two guys kiss in front of my eyes on a full sized cinema screen. Only then would we have attained freedom of sexuality
I hope the 1.7 billion human beings in this country actually start becoming human beings and not a shadow of the authority which buried our own culture in front of our eyes.
