San Diego-based rapper Tiny Doo has already spent eight months in prison, and faces 25 years to life in prison if convicted under a little-known California statute that makes it illegal to benefit from gang activities.
The statute in question is California Penal Code 182.5. The code makes it a felony for anyone to participate in a criminal street gang, have knowledge that a street gang has engaged in criminal activity, or benefit from that activity.
It’s that last part — benefiting from criminal activity — that prosecutors are going after the rapper for.
Tiny Doo, whose real name is Brandon Duncan, faces nine counts of criminal street gang conspiracy because prosecutors allege he and 14 other alleged gang members increased their stature and respect following a rash of shootings in the city in 2013.
Prosecutors point to Tiny Doo’s album, “No Safety,” and to lyrics like “Ain’t no safety on this pistol I’m holding” as examples of a “direct correlation to what the gang has been doing.” No one suggests the rapper ever actually pulled a trigger.
In fact, Duncan may rap about violence but he’s got no criminal record.
I really hope Bobby Shmurda's arrest isn't similar to the Tiny Doo arrest. (Rappers getting locked up over lyrics.) We'll have to wait and see.

しかし全犯罪のおよそ3分の1にギャングが絡んでおり、行政と市民が一体になってギャングの撲滅活動を推進しているらしいんです💦 2000年に可決された法案はその最たる例だ。犯罪活動を行ったギャングだけでなく、ギャングから利益を得た人間も起訴対象となり、ギャングと関わりを持つ市民も仲間と見なして徹底的に排除することが可能となったのがキッカケみたいです…悲惨です。不正してる警察も起訴しやがれって率直に思う。 ダンカン氏はTiny Dooというアーティスト名でラッパー活動を行っているが、その楽曲はギャングの犯罪行為をテーマにした反社会的なものばかりだ。そのため、9件の傷害・強盗の罪状でギャングのメンバー14名が一斉検挙された際にダンカン氏も拘束された。 もちろん、ダンカン氏はこれらの犯罪に一切関与していない。しかし、彼のアルバムの売り上げはギャングを利用して得た利益と判断され、ギャングのメンバーもろとも起訴されることになってしまった。最悪、ダンカン氏は終身刑に処される可能性もあるという。 もしダンカン氏の罪が確定すれば、強盗や殺人などの犯罪歴が一切ない市民が有罪になる非常に稀有なケースとなる。平和ボケした日本からすりゃ賛否両論でしょうけど、個人的には完全に悪夢です。。 ダンカン氏の代理人は本件に関し、「犯罪歴の無い市民が罪に問われるなんてありえない。彼は具体的に犯罪を指示するような歌詞など書いていない。これは彼をおとしめる陰謀だ。この裁判は憲法的に問題がある。」とコメントしている。
自分が直接触れてる訳では無い故に真相は謎だが、
もし彼が潔白だとしたら、心が痛むニュースだ。

A San Diego based rapper, Brandon Duncan aka Tiny Doo, is being prosecuted for a shooting despite being completely uninvolved and unaware or the crime. Prosecutors are sending him to prison on charges of conspiracy based entirely on his song lyrics, which allegedly promote gun violence. This is obviously a huge problem, as in order to sentence him, they want to change the wording of a conspiracy charge to not require direct involvement or to even know a crime took place. This is a serious problem for all artists. If Duncan can be imprisoned for something as simple as classic gangsta rap lyrics, then why not Snoop Dog, who freely brags about drug use? Or Eminem, who frequently sings about violence against women? Or even horror movie directors, for promoting torture and brutal murder? Apparently all creators who incorporate negative behaviors in their works must be punished. No, This isn’t right. And the worst part is that no one is talking about it. This is a serious infringement on creative freedom and a horrible case of blatant racism, yet nobody seems to care. The above link is for donations to Duncan for his bail, and they are woefully below their goal.
