As a Traffic Flagger, I have lost count of the number of times I've almost been hit. I know a lot of flaggers who have been hit, who often don't report it because they feel there isn't much point. Even if the driver is caught they aren't usually charged with much more than failure to obey traffic law. The only reason such a big fuss has been made out of this is because a bystander caught it on video. "Ms. Herback wants drivers to know her job is not to give you a hard time. "We're not out there to make your life miserable, were out there to guide you through the zone safely. If you're going slow enough and you're paying attention we can stop you if something happens – if something falls out of the excavator bucket or a chain breaks on something they're off-loading.
