Considering Gin died two years prior to Ukitake, the ritual that was done to, unknowingly, condemn his soul to Hell has already been completed -- Gin has been in Hell for that duration. It’s not something he can simply walk out of, even if the gates are ripped open, there are chains which imprint themselves into the very skin and linger like scars, unable to be removed, which will inevitably drag him back past the breached gate akin to relentless tethers if Hell is triggered to do so. Zanpakuto cannot break these chains. The cue that causes these chains to go taut, peel away from skin, and begin dragging the victim back to Hell is yet to be determined, there’s no distinct time-limit or distance that signals these chains, but resistance is futile ---- and painful. The longer a soul is in Hell, the more chains that become added to the body. Gin has two, one large chain coiling around his torso, and another around the majority of his reconstructed right arm cloaked in a seething black aura.
