My reply feature is being finicky, but to my homie who replied to the NSA post, I think the natural counter-argument (not commenting on the strength of this argument, but it was the first thing to jump out at me) is that the gov't campaigned against illegal, warrantless wiretapping; and this is distinguishable because they went through the the external review process of the courts to make sure it was legit and got a warrant, making it legal. I think they could also say that they're still holding true to their word of not targeting specific Americans because they're protesting or anything, but that it's just a collection of general non-specific data that they can then narrow down to target specific terrorists: like you need to isolate the terrorist-phone-calls somehow.
For the record, the collection of everybody's phone records does seem over-broad and unsettling to me. I'm just trying to think of the response. Also, I think some people are conflating the phone records with like transcripts of their conversations, which I think I would be more outraged about. Like right now, based on what's in the news anyway, Verizon has to hand over info like '867-5309 called 444-5000 and they spoke for three hours on June 8,' not 'Jenny called Tommy Tutone and they talked about their upcoming date and also their plot to bring America to its knees'
