do you mind summarizing whats going on? the thread is quite long and confusing and i want to be sure i’ve got the facts right. (i mean, as reasonably as that can be done.) all this legal stuff is way over my head.
Here's what I believe are the major points as presented by Yonjin, copied from tohosubs' post here.
* They exposed the Touhou Project without ZUN's permission in a forum (Indiegogo) used by people who are unfamiliar with the doujin culture or the Touhou Project. This will invite criticism even when the service used is not crowdfunding. * The Indiegogo page does not clearly credit ZUN. Saijee tweeted earlier that it used to be shown and that he mentioned it in the trailer, but if it's not immediately clear to anyone who visits the page, it's against the guidelines. * Also, offering download sales of doujin works is currently not permitted. I do think that the guidelines could perhaps use an update given the situation today, but any action violating the guidelines still takes one outside the scope of doujin.

So to summarize the problems: * They used crowdfunding. (Non-commercial is a given for doujin activities) * They put out a doujin work where there are people who aren't familiar with doujin or Touhou. (guideline violation) * Announced download sales, which is not currently allowed. (guideline violation) I would say these three.
(Since it may not be obvious, "putting a Touhou work in a setting where people unfamiliar with Touhou are likely to see it" is a guideline violation because ZUN does not want people mistaking fan products for actual official Touhou products. Fanworks being mistaken for official works has been a problem in the past.)
Admittedly, an effort was made to contact ZUN before the campaign began, but experience in the doujin dev scene would have told From Soy Sauce (the devs for TSSB) that this was extremely likely, if not guaranteed, to not get a direct response.
There was also a debacle surrounding the possibility of the game being put on the Wii U, where the devs were told by Ruw (ZUN's PR guy) that the Wii U was out of the question, and yet they kept hinting at the possibility after that.
Since this all started, the IndieGoGo campaign has been shut down, though there is now the issue of refund-issuing. IndieGoGo's ToS is going to make the refund process a fairly tricky affair, if ZUN's "no crowdfunding" policy is going to be honored in full. That's a mess FSS needs to clean up themselves, however.

Well, it is a rather impressive product. For all of the negativity that surrounded the campaign, few, if any, people actually want to see game production stop. (In fact, N-Forza said he'd be willing to help with overseas distribution.) The problem was - and still is, given the refunding portion still has issues - how FSS has approached development, and how they treated those people I named in my previous post.

The best explanation is simply to read this thread. Note that all of cuc, N-Forza, Drake, monhan, and tohosubs are well-versed in doujin culture and other similar pertinent matters. Helepolis also has a good Japanese culture background and gets what should be going on even if he's not as immersed in doujin culture as the others.
