Santos Chirino was denied asylum in the United States after testifying against MS-13. His teenage children say they face a similar threat.
Santos Chirino testified against a group of MS-13 gang members, sending them to jail. At least one was deported to Honduras.
In 2015, some gang members snapped Chirino’s photo in a bar, leading to a fight. Because of the bar fight, Chirino was scheduled to be deported back to Honduras, “where gang violence is rampant and most serious crimes are never solved.” A gang member told him they would be waiting for him there.
Chirino told all this to the immigration judge ruling on his asylum application in 2016, saying, “I’m sure they are going to kill me.” Friends and relatives sent similar letters to the court, urging “Death is waiting for him” and “He can never go back.” The judge was sympathetic [“Best of luck to you and your family in the future.”], but ultimately denied Chirino’s application for asylum, and he was deported in August.
That December, the immigration judge penned a column explaining his job:
“Take the example of someone seeking asylum. One of our most vexing challenges is assessing credibility — trying to figure out whether the person is telling the truth about what he fears and why. Sometimes, there is not much to go on other than the person’s own testimony. Yet this is not a decision we want to get wrong. I’ve probably been fooled and granted asylum to some who didn’t deserve it. I hope and pray I have not denied asylum to some who did.”
His hopes and prayers were in vain: Chirino was murdered the following April.
