ALTA Survey in Protection of the Buyers Interests
The American Land Title Association or ALTA which came into being in 1907 represents and protects the interests of the investors of the real estate and also that of the mortgage lenders. In a few words it is body that formed to protect investors from any kind of loss from buying a land due to any fault in the title or that abstract of the land. The ALTA is an association of the title and the abstract insurance companies. Almost every abstract or title insurance company holds membership at the ALTA and starting from attorney to real estate broker, lenders, developer, builder, consultants , surveyor, educational institutions and many more comprise the associate members of the organization.
Tasks performed by ALTA
The main task of ALTA is to review, search and insure land titles so that the buyers of real estate properties are protected against any kind of loss. The title or the abstract insurance companies are different from the other insurance companies in a way that these insures the buyers from anything that has happened in the past on the property concerned or if there is anything wrong with the title. Since the title is what proves the investor or the lender to be the lawful owner of the property, if there is any defect in the title it would incur a great loss to them. Thus it is duty or the look out of the ALTA to ensure safety of the interest of such investors or mortgage lenders.
Some other functions
One of the main functions of the ALTA is the standardization of the norms to be adopted by the title insurance companies and most of the companies have adopted these standardized rules and regulations which are almost similar or even identical to those formed by the State. The members of the ALTA are expected to abide by practices like the nature of business they engage themselves to should be at par with the law and should also maintain an ethical behavior. The municipal zoning demarcates the land into separate zones and also regulates upon specific features of the buildings like the height and the ground area occupancy of the buildings. Thus before buying a real estate property an individual or a company must always have the proper zoning document and zoning certificate of that area from the municipality.
The zoning document and the zoning certificate reveal all the vital details of the property which are required to understand the original title of the land. The ALTA along with the American Congress of Surveying and Mapping have together created particular set of rules and standards for the purpose of land surveying so that uniformity can be maintained in survey information of the land and this is known as the ALTA Survey. The survey also sheds light on all the factors that influences the land ownership. This survey has been specifically designed for commercial properties and addresses the needs and the interests of the companies, lenders and the title insurers when handling the valuable and expensive properties.
