LGBTQ activists say they hope lawmakers in other states will also ban the legal defense, which blames a victim's sexual orientation for an attacker's violent reaction.
Starting yesterday, Illinois has become the second state in the country to ban the “gay panic defense,” in which murderers can justify violence by citing their shock at learning a victim was LGBTQ.
The tactic is often used by those who hurt their gay or transgender partners or love interests, or by those who lash out violently against a person who expresses interest in them. According to the AP, “There are variations, but it generally goes like this: A person doesn’t realize someone is gay or transgender and engages in a flirtation, then discovers that person’s sexual orientation [or gender identity] and that discovery triggers a passionate involuntary response such as murder.”
Activists for LGBTQ rights often point to the 1998 case of Matthew Shepard, a 21-year-old college student who was beaten to death by two men, one of whom claimed the victim had made sexual advances toward him.
The activists say they hope the law, which was approved by Illinois lawmakers in May and signed by Gov. Bruce Rauner in August, will provide momentum toward passing similar measures in other states.
“This new law ensures LGBTQ people are not blamed for the violence perpetrated against them simply because of who they are,” Brian C. Johnson, CEO of Equality Illinois, said in a statement shortly after Rauner signed the law.
California is the only other state where this is illegal, and the American Bar Association called for it to be banned several years ago. Here’s hoping Illinois sparks a movement of similar laws around the country.
I’m horrified that this “Gay Panic” bullshit was ever allowed to be used in any court in the first place
FYI: this does NOT ban the Trans Panic defense. it was specifically amended such that it would still be ok to kill someone after finding out they were transgender. as originally introduced it banned both defenses, but someone was like “no, it should still be OK to kill trans people” and this was approved by the assembly. so this is not a victory for “LGBTQ” people, it’s a victory for LG people and a disgusting, horrifying affirmation of the state’s visceral, murderous hatred of trans people.

Back in September, Vox Day, a Gamergate holdover who has assumed the position of racist alt-right figurehead, published a handful of excerpts from what he described as the “Andrew Anglin” style guide. HuffPost has acquired the 17-page document in its entirety, as well as transcripts from an IRC channel where the document was shared in an effort to recruit new writers. It’s more than a style guide for writing internet-friendly neo-Nazi prose; it’s a playbook for the alt-right.
They leaked the entire modern guide to propaganda that alt-right people everywhere, from Rich Spencer to Trump, use. Here are excerpts:
They also speak extensivley on how to mask Nazism as ‘ironic’ or joking. This is why the argument of ‘ironic Nazism’ can never hold up. It is always a cover for deeply held convictions and a way for them to be wormed into legitimacy.
If someone “jokes” about Nazi opinions, treat them like they were serious, i.e., punch them.
Centrists, this guide is how nazis are turning you into their dupes. By playing on your sense of decency and fair play (after all what harm is a joke? I mean, unless it were actually a serious call for violence dressed up as a joke 😒) they are able to spread their messages and plans while using you to defend them.
Pay attention to this and remember: They know what they’re doing. They understand what they are saying. They want millions of people to die and they’re actively organizing the ability to kill them.
Be on the right side of history.
These dudes are really out there using ‘harlot’ and ‘trollop’ in this the year of 2017
This is why you trust your instincts. Don’t try to rationalize with Nazi scum. Don’t try to hold a dialogue with Nazi scum.
