Time management for the Customs Broker Exam
Time management is critical to passing the Customs Broker Exam. The test has 80 objective questions and each question provides five alternatives to choose the correct answer. The test is timed, and you currently have four and half hours to answer 80 questions. Prior to October 2014, the time permitted to answer 80 questions on the Customs Broker Exam was four hours, which meant that a test taker had to answer each question within an average time of 3 minutes. From the October 2014 test onwards, the time has been extended by 30 minutes, so a test taker now has on average 3 minutes and 22 seconds to answer each
question.
I will suggest several techniques that you might like to use for effective time management for the Licensed Customs Broker Exam. Find the techniques that work for you by practicing taking several practice tests.
Practice, practice, practice. The more you practice and use the reference material to answer quiz and test questions, the more familiar you will become with the material and you will also have a better idea of where to look to find relevant information to answer each question.
Tab all reference material using short topic titles, so you can quickly access the relevant topics from your printed reference material. Material is often scattered under different regulations and so proper tabbing will help you to quickly locate relevant information to answer
questions correctly.
Try to work through the test and answer questions as quickly as possible. Do not spend too much time on any one question because each question carries the same marks and there maybe easier questions later in the test which you may not get to answer if you spend too much time initially on tougher questions.
Answer the test questions in two or three passes. In your first pass, answer all the easy questions that you find and the moderately difficult ones. Do not spend too much time on any difficult question. This way you will get to answer all easy and moderately difficult questions on the test where your probability of getting the answer correct and scoring points is high.
Allot 3 minutes on average to answer each question and allocate 30 minutes at the end to review your answers and tackle any tough questions that you could not answer in your first or second passes. Reviewing your answers at the end is always a good idea as you can spot and correct any errors and earn extra valuable points.
The questions vary in their degree of difficulty. There are always a few easy questions which can be answered from memory without having to refer any reference material. You may be able to save time by answering each easy question within 30 seconds or less. This way, you can bank the saved time to answer more difficult questions that require you to refer reference material. Preparation is key to answering the easier questions quickly to save time.
It is helpful to read the call of the question first, especially if the questions involve long fact patterns. That way you know what the question requires you to answer, when you go back to read the facts and you know what to read. Reading the call of the question also helps your mind recall the topics that may be relevant to answer the question.
Nearly 40% of the questions on each test are from two topics viz. Classification and Entry. Practice answering classification and entry questions extensively as this will help you answer the bulk of the test questions and build confidence.
Familiarize yourself with the model online test provided by Customs and Border Protection and read all instructions carefully. You do not want to waste time reading instructions on the actual test and you should know how to use the online test software very well. Reach the exam center early and give yourself enough time to find your seat and set up your reference material in a way that gives you easy access and saves time. Use a stand to organize and hold your HSN Tariff and other bulky reference material. You do not want to fumble with books and papers during the exam and lose valuable time.
Have a good night’s sleep the previous night and be alert and refreshed while taking this exam. Mental alertness can help you spot nuances in tricky questions that you might miss if you are tired.

What is a special examination for the Customs Broker License?
The regular Customs Broker Exam is held twice a year on the fourth Wednesday in April and October unless the regularly scheduled examination date conflicts with a national holiday, religious observance, or other foreseeable event in which case the CBP will publish an appropriate notice of a change in the examination date in the Federal Register.
However, in circumstances where a brokerage is at risk of losing its license by operation of law before the next scheduled examination, CBP may, at the request of the brokerage and on payment of the associated expenses, conduct a special examination for the Customs Broker License, for a prospective applicant for an individual license, who would serve as the required licensed member or officer for the brokerage.
Under § 111.11(b) to qualify for a broker’s license, a partnership must have at least one member of the partnership who is a broker.
Under § 111.11 (c) to qualify for a broker’s license, an association or corporation must have at least one officer who is a broker.
Under § 1641(b)(5) the failure of a customs broker that is licensed as a corporation, association, or partnership … to have, for any continuous period of 120 days, at least one officer of the corporation or association, or at least one member of the partnership, validly licensed [as a broker] … shall, …, result in the revocation by operation of law of its license.
Further, under § 111.45(a) if a broker that is a partnership, association, or corporation fails to have, during any continuous period of 120 days, at least one member of the partnership or at least one officer of the association or corporation who holds a valid individual broker’s license, that failure will result in the revocation by operation of law of the license and any permits issued to the partnership, association, or corporation.
Under § 111.13 (c) if a partnership, association, or corporation loses the required member or officer having an individual broker’s license and its license would be revoked by operation of law before the next scheduled examination, CBP may authorize a special examination for a prospective applicant for an individual license who would serve as the required licensed member or officer. CBP may also authorize a special examination for an individual for purposes of continuing the business of a sole proprietorship broker.
A special examination for an individual may also be authorized by CBP if a brokerage firm loses the individual broker who was exercising responsible supervision and control over an office in another district and the permit for that additional district would be revoked by operation of law before the next scheduled examination.
A request for a special examination must be submitted to the Executive Assistant Commissioner, Office of Trade, in writing and must describe the circumstances giving rise to the need for the examination. If the request is granted, the Executive Assistant Commissioner will notify the prospective examinee of the exact time and place for the examination. If the individual attains a passing grade on the special examination, the application for the license may be submitted in accordance with § 111.12.
The examinee will be responsible for all additional costs incurred by CBP in preparing and administering the special examination that exceed the $390 examination fee prescribed in § 111.96(a), and those additional costs must be reimbursed to CBP before the examination is given.

How do you really know when you’re ready to take the Customs Broker Exam?
Typically, candidates prepare for the Customs Broker Exam by taking classes, reading relevant material, and taking old practice tests. When they pass a few old practice tests, they feel that they might be ready to take the actual exam. There are several problems with this subjective approach to determining a level of preparedness. Test takers may:
pass some practice tests now, but forget information over time and see their level of preparedness drop by the time they take the actual exam.
pass some of the easier old exams but fail a more difficult one.
not take the practice exams under timed conditions, leading to erroneous results.
not take enough practice exams to get reliable feedback.
feel complacent when they repeat the same exams and pass them, but possibly fail a new exam.
For these reasons, test takers cannot be certain about how well prepared they really are by using a purely subjective method to assess their level of preparedness. This is further complicated by the fact that the Customs Broker Exam varies in its degree of difficulty across test administrations and the pass percentage has varied from only 1.5% for the April 2012 test to as high as 34% for the October 2014 one. So, someone who passed the October 2014 test could well have failed the April 2012 one. Uncertainty can lead to a loss of confidence, resulting in poor performance in the actual exam.
How much more confident would you feel if you knew with certainty that you are very well prepared to take and pass the actual exam? We have analyzed this issue and developed a more objective solution to predict a test taker’s likelihood of success in the Customs Broker Exam. Our approach focuses on measuring four important parameters to determine the level of a candidate’s preparedness – Adequacy, Recency, Consistency and Uniqueness.
Our software offers 21 actual old exams in an online timed format for practice. The software keeps track of a registered user’s performance on these practice exams and measures these four attributes to determine whether the user has prepared well enough to pass the actual exam.
Adequacy: The software measures adequacy by evaluating both the number of tests the user has taken and the scores achieved on those tests.
Recency: Recent test scores are a better indication of the current level of preparedness and so the software looks for recent scores and ignores scores that are older than a pre-determined time limit.
Consistency: The test has varied in its level of difficulty across test administrations. So, while a user with a certain level of preparation may be able to pass an easy test, he or she may fail a more difficult one. The algorithm therefore measures the consistency of a user’s scores across different tests to better predict the likelihood of success in the exam.
Uniqueness: The algorithm eliminates scores from duplicate tests because a user can remember the answers from a test and score better by repeating the same test. Such repeat scores are not truly indicative of the user’s capability and are discarded.
We have developed an algorithm that uses mathematical rules to measure performance based on the above four criteria and incorporated it into our Performance Level Indicator (PLI) tool. This tool will tell users whether there is sufficient information to measure their level of preparedness and, if so, whether they are ready to take the exam or not.
The PLI reports are color coded. White indicates insufficient data, red indicates that the user is not ready to take the test, yellow indicates that the user is improving but not yet ready, and green indicates that the user is currently ready to take the test. If your PLI indicator turns green, you currently have a high probability of passing the Customs Broker Exam.
The PLI calculates its results on a real-time basis, and the indicator can change to a different status over time because it continuously applies the algorithm to data from your current performance while discarding old or irrelevant information. This approach is much more reliable than a purely subjective method in assessing your level of preparedness to take the Customs Broker Exam.

Further, under § 111.45(a) if a broker that is a partnership, association, or corporation fails to have, during any continuous period of 120 days, at least one member of the partnership or at least one officer of the association or corporation who holds a valid individual broker’s license, that failure will result in the revocation by operation of law of the license and any permits issued to the partnership, association, or corporation.
Under § 111.13 © if a partnership, association, or corporation loses the required member or officer having an individual broker’s license and its license would be revoked by operation of law before the next scheduled examination, CBP may authorize a special examination for a prospective applicant for an individual license who would serve as the required licensed member or officer. CBP may also authorize a special examination for an individual for purposes of continuing the business of a sole proprietorship broker.

Who is eligible to become a Licensed Customs Broker?
According to U.S. Customs and Border Protection, to obtain a broker’s license, an individual must:
Be a citizen of the United States on the date of submission of the license application and not an officer or employee of the United States Government;
Attain the age of 21 prior to the date of submission of the license application;
Be of good moral character; and
Hold a passing score on the broker’s exam of 75% or higher.
