You remember that post about the homestuck t-shirt design contest collaborating with hot topic? And how Hot Topic are the biggest art thieves? This is recent. As you can see above, I stumbled upon Hot Topic’s website and they are selling a very popular fan art put on a t-shirt, and did not ask permission from the original artist (rismo).

This shows Hot Topic still continues their art thievery. Hot Topic are still taking art from artists without their permission. This is disrespectful and appalling.

Limitation Of Rights The rights and licenses granted to deviantART under sections 3 and 4 of this Agreement require deviantART to obtain Artist consent before deviantART makes any commercial agreement with anyone else to separately buy, license, re-sell or re-publish or commercially use any Artist Materials not in association with deviantART but as an individual work of art or as a group of works from a single Artist in isolation from any other works.

It says RIGHT HERE, says that DA requires additional direct consent to use art commercially, it is not implied consent.

No additional consent is required for any other licensed uses under this Agreement of Artist Materials either as part of the deviantART Site(s) or in connection with the distribution of content groups from the deviantART Site(s) and/or for uses of the Artist Materials made at the discretion of a visitor to the deviantART Site(s) or other users under agreements with deviantART. deviantART will contact Artist in writing about any individual commercial uses of Artist Materials instigated by deviantART.

This part states that the artist doesn’t need DA’s permission to commercialize, and also removes DA from responsibility if someone right click saves or screen caps someone’s DA page.

Additionally all of sections 3 and 4 have to do with giving DA the ability to legally make thumbnails, use the random system, display snippets for advertisements, use snippets in mosaics, screen cap their own pages, and any ability at all to use your upload on their site for your display purposes.

None of this legal jargon (and I have read DA user’s agreement many times in the years I’ve been on DA) says that agreeing to it, is implied consent to commercial use of other third parties. Additionally, almost every other single art site’s agreement looks like this. (read tumblrs for goodness sakes) Because, remember, any form of copying a piece of work, that means making thumbnails, and different view sizes, is a form of copying and is a violation of copyright UNLESS, the site has permission to make those copies.
