What is a Status Certificate and why is it important?
A “Status Certificate” is a set of documents that are prepared by a property management company on behalf of a condo’s Board of Directors. These documents include information on an individual unit and confirm that the owners have paid all of their maintenance fees and are not in arrears. The Status Certificate also includes the condo declaration, the by-laws and condo rules, the current budget, information about the state of the reserve fund, whether there are any upcoming special assessments, insurance, the management contract, minutes of the last annual general meeting, and mention of any lawsuit involving the corporation. In total, the documentation can be as long as 100 pages.
The purpose of the Status Certificate is so that a new Buyer of a condo unit has as much information as possible about the financial and physical state of a building. The information also lets them know what the condo rules are such as whether pets are allowed or whether barbecuing on balconies is allowed, etc. Small things that can be critically important the lifestyle of a Buyer.
The requirement for a condo Board to produce Status Certificates is mandated by law through the Condominium Act. Usually boards delegate this task to their property management company. By law, the management company is allowed 10 calendar days to prepare the Status Certificate.
If you are a Buyer purchasing a condo, you should always have a clause in your purchase agreement that states that the offer is conditional upon receiving the Status Certificate AND having a chance to review those documents with your lawyer. The cost to prepare a Status Certificate is usually around $100 and that fee is usually paid by the Seller.
