Will the Defense Convince the Judge to Impose a Lesser, Non–Guidelines Sentence?

Josh Sentencing Series. Part 3 of 3.

We went over the basics, then tried to apply the Guidelines to Josh, calculating that the all–important Offense Level will…

Definitely be At Least 28, which corresponds to a Guideline Sentence of 6.5–8 Years;

Probably be At Least 34, which corresponds to a Guideline Sentence of 12.5–15.7 Years;

Possibly be as high as 42, which corresponds to a Guideline Sentence of 20 Years—the Maximum Penalty for Receipt of CSAM.

But, the Guidelines aren’t mandatory; they’re only advisory. Judge Brooks can deviate from them if the Guidelines just don’t seem to fit, given certain facts of the case at–hand. Lawyers like to call this a ‘variance’—and such a ‘variance’ can be ‘upward,’ i.e., a longer sentence, or ‘downward.’ Here, the Defense is requesting a downward variance. The Defense applied the Guidelines in their Sentencing Brief, and came up with an Offense Level of 28, and the Guideline Sentence for that is 6.5–8 Years. But, they are asking for less than that. They want only 5 Years. To get there, they will have to convince Judge Brooks that Josh deserves a “downward variance” from the Guidelines.

Judicial law clerk here. Loving this analysis! In my experience, deviating from the guidelines is pretty rare, and it usually happens downward (again, completely anecdotal) when there is truly a special circumstance, like when someone was the only source of care/income for a dying relative or when they for whatever reason are truly less culpable than normal. I’m going to guess 12-16 years here, but I do think 19 is an (unlikely) possibility given the prosecution’s allegations about the number of images.

I didn’t get to hear everything, but it sounded like Carlin was brought to the hospital via ambulance again. While in the ambulance she had another seizure (?). The hospital gave her meds for the seizure and it sounds like she’s scheduling an appointment with a cardiologist.

These folks are so sheltered that they can’t see why letters like these might persuade a Judge to lean towards a longer sentence, though there’s not much flexibility in the sentencing guidelines anyway.

How statistically unusual is it that Justin + Claire haven't announced a pregnancy yet?

How Late Are Justin + Claire For Pregnancy #1?

It's fairly unusual. Currently (May 10, 2022), Justin + Claire (Spivey) Duggar are ~2.28 SDs and 246 Days Late, and counting, to announce their 1st Pregnancy. That’s pretty late. Assuming a normal curve, it’s actually in the 99th Percentile for Duggar Marriage–to–Firstborn Spacings. (Wow!)

At this point, Justin + Claire are actually on–track to set a new Marriage–to–1st Child Record among 2nd–Generation Duggars. Currently, the record is held by Jinger (Duggar) + Jeremy Vuolo, who welcomed Felicity after 621 Days (or 20.4 Months) of marriage. Assuming that Justin + Claire eventually announce when Claire is 98 Days Along, as is Duggar–typical, and that the baby arrives 2 Days Early, as is Duggar–typical, Justin + Claire actually will set a new Marriage–to–Firstborn record unless they announce by this Friday, May 13, 2022 (Tomorrow).

I hope Justin + Claire’s lack of pregnancy is as a result of intentional efforts to wait until they’re a bit older and more established in their relationship. (Which would be pretty ironic, since that decision shows a lot of maturity!) I hope the delay isn’t due to fertility issues, loss(es), etc.

Well-said! I have wondered about the reasons as well, but it’s hard for me to picture them choosing to wait since both families seem so extreme…but Hilary “only” has six kids, so maybe she’s used some kind of family planning?

What’s with the Duggar social media hiatus?

Not all of them are abstaining, of course. Jessa, Jill, Jana, Jinger, Jed and Jer still seem pretty active. Joy, Claire, Justin, and Abbie seem to post once in a while, though less than before. It’s Lauren and Kendra (well, and Anna) that seem to have gone dark.

I wonder if this absence is permanent or if Kendra, Lauren, and Anna are just biding their time until Josh is sentenced. I’m especially curious since I think Lauren and Kendra are both either pregnant or recently postpartum.

Hearing their family updates is interesting from a data point of view, but it would probably be better for their families if they lived more private lives. Honestly, less attention might also mean they (particularly Kendra) feel pressure to have literally as many children as possible.

I guess we will see!

So I know you linked a different site, but according to InTouch they contacted local authorities and clarified that the crash happened in October 2021. It seems like they are doing OK now! If WOACB is to be believed, Abbie is no longer comfortable with flying on the small planes.

After running out of fuel, he crashed his Piper PA-30 into a Waverly, Tennessee field on October 29, 2021.

The Humphrey County Sheriff’s Office confirmed the crash to In Touch but could only verify that a family from Arkansas was involved. John David, 32, and his wife, Abbie, 29, live in Springdale, Arkansas.

These small planes are so dangerous. I lived on the East Coast near enough wealthy people that every couple of years, I would hear about someone’s family member or close friend perishing in one of these crashes. If it’s true he still chose to fly knowing there was a defect in his equipment, he is extremely foolish.
