Australian Media Company Fined for Not Paying Interns

SYDNEY, Australia — An Australian media company that did not pay its interns and breached the nation’s labor laws has been fined in federal court in a decision that will affect workers across Australia.
Crocmedia, a sports broadcaster based in Melbourne, was fined 24,000 Australian dollars, or about $18,900, on Thursday in the Federal Circuit Court of Australia, after Judge Grant Riethmuller found the company had exploited two young interns — one a student and the other recently graduated — who had been looking for work in the media industry.
One intern, Gemma Smith, 20 at the time, produced radio programs, starting her shifts at midnight and working until dawn for about six months. The other, Jonathan Wilkinson, then 23, worked similar hours over 15 months at Crocmedia, also producing radio programs. The two were together owed about 22,000 Australian dollars, or about $17,400, based on a minimum wage for casual shift workers of about 18 Australian dollars an hour.
In a statement, Judge Riethmuller said that Crocmedia had engaged in an arrangement to avoid its obligations. He said that Crocmedia had not intended to deliberately exploit the interns, but “the company cannot avoid the proposition that it is, at best, dishonorable to profit from the work of volunteers, and at worst exploitative.” The lawsuit was filed in June of 2013.
The ruling, closely watched by labor law academics and lawyers, is intended to send a strong message to employers that underpaying or not paying young workers could result in legal action and fines.
“It is groundbreaking because the regulator pursued the issue, and the company has been fined,” said Josh Bornstein, an employment lawyer with Maurice Blackburn Lawyers. “It sends a message that businesses should not cross that line.” The regulator, Australia’s Fair Work Ombudsman, which oversees workplace issues, took the case to court on behalf of Ms. Smith and Mr. Wilkinson.
Experts said the case would cause ripples throughout the work force. “This is a big development,” said Professor Andrew Stewart of the University of Adelaide’s law school.
He said that the judge could have imposed a penalty as high as $90,000 but that the company eventually had paid the interns in full and restructured its work force. “And because of this case, a number of other companies known to use unpaid interns” have undertaken not to do so in the future, Mr. Stewart said.
Mr. Stewart and Rosemary Owens, also a law professor at the University of Adelaide, prepared a report for the Fair Work Ombudsman in February 2013 that found the practice of using young people and not paying them was common in some industries.
Judge Riethmuller warned in his written judgment that future breaches would attract high fines. “There can be little doubt that the penalties are likely to increase significantly over time.”
In Australia, short, fully supervised unpaid work trials to test a job applicant’s skills are legal, as are college-backed, short-term student placements that allow the student to accrue course credits for a term of work.
But a benefit test that shows whether the intern or the employer gains the most from the work completed is one factor that determines whether a worker should be paid, and whether the employer is breaking the law.
Crocmedia’s marketing and communications manager, Leah Grant, was not available for comment. A lawyer for Crocmedia did not return calls.

I am not sure what your question really means. There are a million kind of internships (some paid, some unpaid, some offer a form of compensation/lunch/metro card/stipend). Depending on the hiring process you will apply online, via email or reach out directly to people to seek opportunities.
Every company/org/designer/artist has a slightly different hiring process so I can't really offer much more insight than that. Is there a specific industry you are targeting or company?
How do I make myself look desirable to internship employers?
A clean, neat portfolio of work (a few samples at least) that is easily accessible online. It must be clearly categorized. People want to see your process. *Note I am not saying you need a website. A tumblr will work, too!
A resume to send when asked
Be able to articulate your decision making, why you are pursuing whatever it is you are pursuing and have humility, confidence and self awareness.
Meet people, talk to people with similar interests - go to networking events, conduct information interviews, ask a lot of questions. Be genuinely interested.
If you want to be a designer, have design work. If you want to be an animator, have a reel (or illustrations that move at least). If you want to be a fine artist..... Consider using your school's portfolio site - portfolios.pratt.edu (if you are a pratt student) if not - behance.net is a great one (same thing). When you are out meeting people, write down their name, send an email follow up and a thank you - and a link to your work!
If you use social media, follow the people you are interested in - communicate this way with them! If you do not use social media, do not do this - it will just stress you out to set up accounts etc...

How do I find an internship in another country?
Your approach should be the same no matter what country. Start with research!
*Without knowing more about what you are seeking in terms of skill development (your goal for taking an internship) - I can’t be super specific however, here are some things to think about:
I suggest you start by thinking about who (design firm, artist, agency, company, nonprofit, group) are doing the things that inspire you/your work/your reason for pursuing a degree. Where do they have offices? Do they have locations abroad?
In addition, you need to research a little bit about labor laws in the country you intend to work in: How long can you get a visa for? Are you allowed to work there? Will they require you to be enrolled through your home institution (school) to take an internship?
Lastly, think about language and cost. Planning and budgeting is really important. It is more cost effective to travel and intern with a friend and share room and board, food costs, plus it is more fun to have a friend going through the same thing as you are! The seeking and hiring process will be made more difficult if you do not speak the language of the country your are pursuing an internship in, so keep that in mind.

Be warned, their services can be costly. The provide nice services but I find that students can often figure out this stuff for themselves and travel for a lot less money than the fees for these kind of programs.
To me, your question shouldn’t be how do I find an internship in another country because talking to people and using the internet are the answer.
Maybe consider the following instead:
Why do I want an internship abroad?
Who is doing the things that I want to learn to do?
Where are they located?
Do they have an online presence and do they have a 'careers' page explaining how they hire/if they have opportunities available?
What is the best term to intern abroad (if I get hired), how long will I have to save money and work towards getting hired?
What is my projected budget to move out of the country for a few months?
What will a global work experience be able to provide me?
Has anyone done what I am attempting to do and can I reach out to them to ask some questions?

Digital Stewardship Residency (NDSR)
We are pleased to announce that application requirements to become a resident for the upcoming Washington, D.C. class of the National Digital Stewardship Residency (NDSR) program are now available on our website, located at http://www.digitalpreservation.gov/ndsr/applicationinfo.html?loclr=ndsr.
The site contains information about how to apply to the program as well as specific requirements. The D.C. residency will start in June 2015 and end in June 2016.
Over the next few weeks we will select the 5 hosting organizations for the NDSR program in the Washington, D.C. area. Those host organizations and their corresponding projects will be published to the site on December 15, 2014. The application period to become a resident will open on December 17, 2014 and will close on January 30, 2015. Resident candidates are asked to identify their top 3 project choices in their application materials.
The NDSR is a year-long field experience for recent graduates focused on developing the next generation of stewards to collect, manage, preserve and make digital assets accessible. The program was developed through a collaboration between the Library of Congress and the Institute of Museum and Library Services.
