"Beef" and Indian Nationalism
Why do media, parties, social media have so much Beef on action against illegal slaughterhouses in UP.

Indian Nationalism is probably strongly rooted as a “Territorial Nationalism”. Essentially non expansionist but very protective of its territorial identity. Recently, a small group, in some educational institutions in the National Capital, made inflamatory statements against this and were supported on various grounds including “education Institutions are the breeding ground of free thoughts”.
Influences of “Cultural Nationalism” to a large extent also bind the country. It has been one where the assimilation of cultures has been core to India. However , some historical actions like the attempt to thrust a national language down the throat of those whose language and cultures were not similar may have brought to the fore a divide like some ethnic Nationalist movements?
The “Political Nationalist” movements and 2 nation theories were disruptive initially, but once divided these settled down to forming a National identity as one major party controlled the legislatures for some time. Today the fractured polity has led to regional parties and the cohesive influence of one large party has reduced; though this appears to be reversing. Parties to gain influence may be instigating knowingly or unknowingly against a common spirit or thread of Nationalism. Add to this armchair analysts and a vocal media which gives more weight to influences which could disrupt a common thread/ thought/ spirit and you have a potentially explosive mix.
The two Nation idea, fostered “Religious Nationalism” and this divisive force continues to impact the politics and legal and cultural and social sphere in India. Today “Beef” with slaughterhouses, couched in all its legal intent, may be a manifestation of hardening stances; this is a very emotional issue and except Bengal , some NE states and Kerala , this practice is restricted across India. One must be extremely cautious when upsetting the illegal status quo
I wonder where Reservation, Class and Caste crept in. Essentially based on protecting and upliftment, this probably did highlight divisions and may have created frictional areas. Much of todays youth may be vexed with restrictive opportunities and thus may be open to political manipulation.Today everyone wants reservation and this is also the reason for much strife (North India). Reservation may be as much of a boon as a bane to Indian Nationalism
A lot of the backward areas were probably also looking for economic, social and cultural identity. This may have led to movements like Naxalism and fostered alienation from mainstream (sic !)
Initially, the Constituent assembly had gone into many of these issues, but maybe time has come to look at all these conflicting pressures with an open mind and come up with solutions more aligned with todays India.
The Constitution, which is an important document along with its amendments, was never even communicated effectively to the “Aam Aadmi”. It is some nebulous idea which probably exists in the fertile minds of media and experts in law. Maybe, even before taking a relook at amendments required, an effective Communication of this may kindle a much stronger Nationalist feeling.

World risk, US protectionism, the China Russia Pakistan axis to counter US and Islamic terror all have implications for India. Are we on the way to cold war type deterrence for India?!!! India must have effective deterrence for Chinese and Russian threats
Economically, the look East policy has also got to be implemented effectively. India has to actively open markets and participate proactively with various trade blocks too.

1.7.1 FIFTEENTH SESSION, (1957)
1.7.2 At the 15th Session of the Indian Labour Conference held at New Delhi in July 1957, an important resolution was passed, which laid down that the minimum wage should be need-based and should ensure the minimum human needs of the industrial worker. The following norms were accepted as a guide for all wage- fixing authorities including Minimum Wage Committees, Wage Boards, Adjudicators, etc.:
(i) In calculating the minimum wage, the standard working class family should be taken to comprise three consumption units for one earner, the earnings of women, children and adolescents being disregarded.
(ii) Minimum food requirements should be calculated on the basis of a net in take of 2700 calories, as recommended by Dr. Akroyd for an average Indian adult of moderate activity.
(iii) Clothing requirements should be estimated on the basis of a per capita consumption of 18 yards per annum, which would give for the average worker�s family of four a total of 72 yards.
(iv) In respect of housing, the norm should be the minimum rent charged by Government in any area for houses provided under the Subsidised Industrial Housing Scheme for low � income groups ; and
(v) Fuel, lighting and other miscellaneous items of expenditure should constitute 20 per cent of the total minimum wage. The Resolution further laid down that wherever the minimum wage fixed was below the norms recommended above, it would be incumbent on the authorities concerned to justify the circumstances which prevented them from adherence to the aforesaid norms. The Resolution, thus, tried to give a concreteness to the whole concept of minimum wage.
In 1991, the Supreme Court in its judgment expressed the view that children�s education, medical requirement, minimum recreation, including festivals ceremonies, provision for old age and marriage should further constitute 25 per cent and be used as a guide for fixing the minimum wage."

Non Govt College issue - Govt creates its own mess and complications, see variables it creates- it is natural that as time goes by administration will be difficult. Who is to blame? Are students to suffer?
Sedition is the new Arranged Marriage- Business News - I am confused and I may not necessarily subscribe to the authors view, he is a friend; but I feel that what India needs is something which inhibits the frustration (as pointed out by him) in the general populace.
Be it a correction of the systems and processes to meet the expectation of the people or checks and balances to prevent inciting unrest or violence; I agree with the SC judgement that for sedition, violence or incitement to violence is one of the tests.
In a highly populated country like India, with limited resources, it appears natural that a sense of frustration, entitlement and deprivation will exist. People will always act individually or in groups to mitigate or fulfil these feelings. Many cases of corruption, lawlessness or other actions may have their Genesis in this. This feeling also exists in other countries too. Historically, some countries went though revolutions for this and still continue to face these issues. Is it then right not to have any check on negative feelings and its propagation under the garb of being draconian and out of times? Are we then always looking for revolutions? I am not, I am comfortable with the concept of India as it is today.
Whether the sedition law or the other laws preventing freedom of speech is justified or not, I believe that the principles of article 19(2) of the Constitution as originally envisaged are needed for a multicultural, multilingual and multi religious nation like India to retain its cohesiveness.
The JNU cases may have been restricted to the campus, but what of the media and the discussions on public platforms which have whipped up public sentiment. Also is it not sometimes true that applying a law to prevent an action achieves exactly just the opposite. Are these also not subject to violation of article 19(2) of the constitution?
Let me carry on further about the issue of freedom of expression and actions which are violative of this freedom (also additionally, freedom of action) or of its restraints as defined in article 19(2). What of bandhs, is it not disruptive of public order? What about Dharanas blocking public roads, even if done by a CM?
I would request some of my lawyer friends to guide me on this confusing issue. I promise to post the gist of their views in this blog later…
Life's journey
2016, 3 JanDetails Dear Daisy, Tulika and Prem
After my heart procedure, I was told by Daisy how shaken up Prem was. This has got me to do some introspection and here are some thoughts.
Firstly, I thought about what is a family? I feel a family is something one can always fall back upon to recoup and replenish ones energies and also to know that there is someone who cares. Over time these feelings reduce as each has their own nuclear family or professional imperatives, however, do recall that it is very rare, that later in life, one will feel the selfless security and warmth of the family. The basic foundation of a family is concern for each other; it is this concern which makes one ask at what time Tulika's flight will reach, or just calling up to talk or listen to each other. It is not essential that these interactions are logical, however if the lasting feeling is one of warmth, then it must be good. It is also true that a concern for one of the family does not override the concern for another. These interactions I feel are essential for a family to survive, else it might just break up.
Secondly, in each of our lives, we undertake a journey - the journey of life.This can be compared to the progress of a stream starting from a river(your parents). In the initial journey the stream is nurtured by the river,the stream is impetuous and wants to explore various aspects of its route, it’s power and ability are guided by what the river feeds it. As it grows older, various streams arising from the river start diverging and undertake their own journey and are in turn influenced by other streams and trickles and waste products and many nutrients they pick up along their journey. These are your friends, teachers, bad and good influence- all these build the character of the young stream. Rocks and obstacles on the way are happily accepted and either overcome or bypassed. The stream grows older in its journey, it is now fed by other streams and it starts to rely less on the river, though still it gets most of its water from the river. It turns into a rivulet. The rivulet faces its own challenges, however as it has more power, it starts to decide its own paths. Depending on its character, some rivulets face challenges head on and overcome them, some bypass them and some get stuck. But remember if even a dam is in the way, over time, the reservoir fed by the rivulet will overflow the dam and the rivulet will proceed on its journey. Finally the rivulet with many other inputs turns into a mighty river- Gautam like that Mahanadi, has reached Cuttack after facing its many obstacles and mostly runs dry. But once in a while during floods , it shows its irritation with the surroundings and then gains the ability to sustain its dependants. Eventual the river having neared the sea will immerse with it. Daisy- became like Ganga, not only nurturing its branches with great energy for much longer, but, it also nurtures everyone it touches. However, even the Ganga gets polluted by what people put into it. It requires a clean Ganga or a program to put less waste and stress on the mighty river for it to sustain its a ability to provide succour to many. If we continue to pour our distressed waters into her, she will one day loose the ability, which is her core. Let us not load all our waste on Ganga, but utilise the Purity to sustain and motivate us. Prem- Hopefully on the way to becoming like mighty Brahmaputra, capable of sweeping everything in its path, but also sustains. Today he has stresses and challenges about his profession, also his distress at his Fathers condition makes him attempt to give up cigarettes which were also sustaining him though polluting him. It is for us to understand these when we interact with him. Tulika-yet to find which river she will become, has a greater stress level and even easy obstacles are seeming insurmountable. She needs to understand that finally, the influence of others are irrelevant, but it is her own inherent a ability ( and nature) which will help her achieve her potential as a river. Probably over a period she could become like the Amazon, the longest running river in the world- all her childhood influences and pressures of peers will be irrelevant. She may take longer to develop, but in the journey of a river, small delays and dams are finally insignificant. Having hit what she feels is a dam, she needs our support to gather her inner strength. This will help her finally overflow the small dam, or simply bypass it laughing at its attempt to block her, it may even be just a tree blocking the path, which will be swept away.
Thirdly, I always wondered what was the most basic cause of worries and irritation. I feel, it is the weight of expectation. Our expectation must always account for time and obstacles. Also what matters is our expectation of ourself and not what others may expect of us. Many a time, I have got into a tizzy over what will happen in the future, will I meet my expectations, will I meet others expectation of me. Over a period of time I have learned to ignore others expectations and am much more relaxed, happy and have been able to achieve much more than many (in my environment at Orissa). I refuse to mentally compare myself to those better or worse, I live in the moment though plan for the future; I believe you would be happier too if you could follow this. Your expectations get tempered dynamically with changing situations but unfortunately other expectation of you do not, and just add pressure. Never give in to this pressure, as this will prevent your functioning to the best of your ability.

Why are Ministers unable to take decisions quickly
I find that many issues in Odisha tend to drag on despite a desire to resolve them. A group of senior Ministers reviewing some issues of Private College Teachers, prompts me to question, why is this so?
Has the role of the Minister in the decision making process been degraded?
The Political leadership represented by the Minister is probably important in the DM set-up to give weightage to the constituents needs. The Minister is the one who has to judge the impact of delayed decision making on the polity. He is the one person who will bring the feelings and personal impact of the decisions into reckoning in a largely impersonal Government DM process. Government decisions may normally be skewed, and decisions based on Finance availability alone will be surely skewed, it is only the Minister who can enforce balance. If the importance of the Minister is somehow lessened, compared to a more concentrated political authority, or a perceived powerful bureaucratic channel capable of undermining Ministerial authority, then we may have one cause for decisions not connecting to the ground requirements, and whatever decisions are made having no appreciation of the impact caused by delayed decision making.
Has each department forgotten its role in the DM process of seeking to improve effectiveness, efficiency and administrative ease in its functioning, in proposals it makes for approvals?
Departments must inter alia consider their administrative ease, effectiveness, and efficiency when making proposals and justify for overcoming possible bottlenecks. We, however, have Departments creating their own bottlenecks in proposals. The Clerk is trained to look for flaws, but the senior officer forwarding such proposal makes little sense…. The Departments must leave the task of objections largely to other interacting departments like Finance Department and Law Department for example. In the present case, the Higher Education department appears to be an extension of the School and Mass Education Department. Has it forgotten that their goals are not the same as they were when they were one. If School and Mass Education needs teachers, why do they not contract them. The Higher Education Department will need teachers in the immediate ratio of 20:1 (Student: Teacher). In the Government Colleges, this will mean a three fold recruitment and so also in the Aided Colleges. Where is the logic of Higher Education deputing teachers to School and Mass Education justified?
Has the bureaucratic process for all actually turned from a ‘will try to do’ ideal to a ‘will try to impede’ system?
The Bureaucracy surely needs to answer this and the Political leadership must seek to identify whether the processes are leading to this. A subconscious manifestation of this is also a clear attempt to bring as much differentiation and distinction on the applicability of existing rules, or framing of new complex rules not allowing transparent applicability, to enable delays in any forward looking processing..
